tier conhpany. ' Upon motion of the de
fendant's attorneys the complaint was dismissed because of Its faulty construction. Failure on the part of the traction company's attorneys to state in the complaint that the defendants had "wilfully" violated the injunction resulted in the' complaint being dismissed. Statutes are specific in stating that a wilful violation muts be stated. The court, however, gave the plaintiffs attorneys permission to amend the complaint and thus hale Bowser and Castleman before the bar once more. Am Impost uk Legal Staff. An imposing array of legal 'talent was on hand to help the Gary aldermen over the rocks. They had CrumPacker brothers and Dailey of Valparaiso. Senator Frank N. davit of Whit

Gary. The traction interests were rep
resented by Wildermuth and Carnduff
of Gary.
Carnduff States Hi View.
According to Attorney Arthur
Carnduff representing the traction company the case is not ended and he does not construe Judge McMahan's
ruling yesterday as a final dismissal o
the original complaint as the company's attorneys intend to argue further on it Monday or possibly next Thursda. "In an event," said Mr. Carnduff. "A dismissal of the original complaint does not throw the case out of court but it gives Us power to amend ant this we intend to do."

The franchise absorbing department of the Calumet United railways which was so successful at Chesterton on Wednesday is now moving westward and it may be possible that at Monday's session of the board of public works representative of the company will apply for a franchise in Gary. Promoter Gelst, of the Calumet line, has also filed an application for a franchise with the Porter county commissioners. , Big; Franchise Campaign On. Chesterton has welcomed the line
with open arms. In fact, Charles
Gelst, the Philadelphia gas magnate,
began his operations there and from
now on his quest for franchises along the route will not be stopped until the
necessary rights are secured.
The Gelst line will link Chesterton
with Gary, Kast Chicago and will have its terminus at South Chicago. Ultimately it is expected to build across
the state of Indiana and thus give it
Ohio Interurban connections. Several
days ago the report was circulated
that the Geist crowd were trying to buy the Xew York-Chicago Air Line
with its subsidiaries, such as the Goshen & South Kend. the Valparaiso &
Northern and the Gary & Interurban,
but Senator Frank Gavit. the presi
dent of the last named company, denied
the report.
Barked r Umn Sterner.
A month ago Geist's gas interests
throughout northern Indiana were in
corporated under the name of the
t'nited Gas company, and it Is ex-
pVted that this wealthy corporation
will back the interurban properties.
The Calumet line will rival the South Shore Interurban system, which has developed considerable opposition
at Chesterton. Miller and other points
because of its disregard of convenien traffic schedules. ' Miller Will filve Hlghta.
Some time ago President William
Olander of the Miller town board de
clared that the Geist company would be received with open arms at Miller,
where sentiment is strong against the
South Shore line. Recently that com
pany changed its schedules so that
many Miller workmen who are em
ployed on the 6 o'clock shift at the steel mills have to quit their positions or move from the town because of the lack of- an early car. Steel mill employes quitting at 6 o'clock in the evening are obliged to remain in Gary until
8 p. m. because of the change of schedule. On account of these tactics ajiy rival line will be gladly accorded ' a franchise by the Miller board. rWill Spend Million. Some time ago engineers of the Calumet United began to survey its right of way. Geist has hi3 eye on a possible route tapping all of the main gates of. the United States Steel corporation's Gary plants. ' Once actual construction! work Is started it Is expected that the company will spend millions in the Calumet district developing interurban facilities.

It is reported that the Harriman lines are about to close with the Illinois Steel company for 21,000 tons of standard rails for early shipment, orders which are likely to be Increased later in the year.
