When M. N. Castleman, of the fifth ward, tendered hla written realgnatioa to the Gary conimo" ronncll during the midst f the aeaaton on the evening- of 3v. 7, ke then and there ceued to be a city official and no formal acceptance of hla resignation is necessary to deprive him of his office. This Is the opinion of the best leg-al talent of Gary, following: a close study of the state
statutes, the Indiana supreme court reports and the reports from other states and the supreme court at Washlngrtoa. . Last Monday the republican majority in th council sought to accept Castleman's resignation, but gavel rule was resorted to by Mayor Knotts to stop them for the time being. On the other hand, Castleman filed a written withdrawal of his resignation, but this was not accepted. Uw Shows It. 1 A review of the law on the subject shows that: A resignation la la effect when It is submitted. Even if a resignation Is submitted to take effect at a later date a successor caa he elected at once. There can be no withdrawal of a resignation once It la made, even if the person or body to whom it is made concurs in the withdrawal. The United States supreme court holds that a resignation Is fa- operation once it is placed in the bands of the proper authorities aad that the office Is thereby made vaeant without the acceptance of the resignation. While a written resignation was tendered by Castleman. the state su
preme court has held that a verbal one is sufficient. ' , From fact it Is conVludedt ! That Castleman" s seat was vacated Immediately upon the reading of his resignation in the council chambers Nov. 7. , That the action of the council in tabling it, then trying to accept It and his subsequent efforts to withdraw it were of no avail, and that he stands without an office. That it is now thoroughly within the province of the city council to recognize a vacancy in the fifth ward and to elect a successor, as provided for by statute.

SLOT MACHINES MUST 60 IS THE EDICT
Slot machines in Gary must go. This was the order that was given by Chief of Police Joseph Martin yesterday afternoon, and before an hour had elapsed every nickel slot machine in the city had been placed in the back room or turned to the wall. It is understood that Prosecuting Attorney Chas. Greenwald instructed Chief Martin to notify the slot machine owners in Gary that they would no longer be allowed. The penny slot machines are operating today, as usual, and, it is thought, no attempt will be made to put the ban on only the nickel machines. , Prosecuting Attorney Greenwald was in Gary this afternoon to see that his orders were complied with.

The Investigating committees of the National Association of , Brick Manufacturers and the National Association of Contractors met in the federal building in Chicago this morning to confer with an assist ant of V. S. District Attorney Sims, relative the brick contract letting In ary,' since the city was founded. From this office a long distance telephone conference was held with V. S. District Attorney Miller at Indianapolis, who Is expected to prosecute as soon as all the evidence bas been laid before the federal grand Jury.

The national association will push the Gary investigation and prosecution from funds in the treasury set aside for the purpose. It is stated that the investigation will be on the same line as the one last summer in the United States District court in Chicago, when the Metropolitan, Barr and other brick agents were indicted on the charges mentioned in the preceding paragraphs. The Metropolitan company will be the chief one under fire in the Gary investigation. To Probe Back Until 1904S. Contract letting methods of both the city, council and the old town board will be delved into by the association's attorneys and detectives and this with evidence which the association is now said to possess and which Is said to have been furnished by outside contractors who were discriminated againt in Gary is to be laid before District Attorney Sims in Chcago and the federal grand jury. Was There Bribery? One- charge said to be before the committee is the alleged declaration said to have been made by a Gary contractor and for which it is said that there at witnesses, that the contractor had to pay $2 per thousand for all
brick he put in Gary and that the
money went to certain city officials. The next charge before the committee is said to be to the effect that affidavits stated to have been made by disgruntled contractors show that a local contractor promised to pay outsiders cerain sums if they did not bid here and that because the money was never paid they have now complained. Will Question Early Deals. Testimony is also said to have been secured from a former Gary contractor, which it is declared, will be the most sensational of all, not only in its scope but the persons involved. This contractor, it has ben announced, will tell all before the federal grand jury. Testimony will also be sought from inspectors and former employed of the cUy engaged in inspection work will be sought to determine the causes of high assessments in Gary. Further sessions of the committee will take place this week and it is expected that it will present its evidence to the federal grand jury wihin a short time.
