Unless the dty of Gary la enjoined It, will take possession of the town and property of the town. 5. The town funds will be appropriated by the city of Gary. 1 6. The town hall and fire equipment, valued at 15,000, will fee confiscated. 7. The town of Tolleston la making extensive improvement and If annexation takes place great confusion will result. 8. The credit of the town of Tolleston will fee destroyed. 8. The right to annex, claimed by Gary, Is unfounded. 10. The city of Gary is In debt to the 2 per cent limit and In the event of annexation Tolleston'a funds will be diverted to Gary's use. 11. The proceedings are void In that the ordinance attempts to annex only part of the town of Tolleston. - 12. The act of the general assembly is unconstitutional. ;': 13. There never has been a vote taken on the union of the cities. WHY UNCONSTITUTIONAL. ' ihe reasons why the act of the general assembly is unconstitutional are numerous are as follows: (a) The act contains an unlawful delegation of legislative powers. ' . (b) It attemps to authorize the creation of a corporation by a special act. (c) It vests power In the annexing city without attaching any conditions or directions as to its exercise. (d) It attempts to grant legislative powers to the courts. (e) It attempts to limit the range of judicial inquiry in' determining whether annexation shall take place. (f) It Is subvervlse of the right of local self-government. (g) It attempts to vest the legislative power to annex in a municipality ether than the one sought to be annexed.. . ' Two cases were filed. One was entitled, "The Town of Tollestqn vis. the City of Gary- The other was "William Kriewitz vs. the City of Gary." The complaint prays that the annextion be declared null and void, that Gary' title in Tolleston's town property be quieted and that Gary be enjoined from taking possession of the town of Tolleston.

of offenses, how long he was In for. When he elarned that his term was 110 days Frank opened his eyes in amazement and asked whether he had murdered anybody. Told he had not, but that the length of the term was merely for the purpose of saving traveling expenses, he seemed relieved. $PED mHTHDAV IX JAIL,. But a look of anxiety once more appeared upon his brow, and Sergeant McCormick asked why so sad. "I am afraid that I won't be out In time to celebrate my birthday," was the response. "When that?" inquired the official. "September 24." A little figuring on Sergeant McCormick's part showed that the 110 days left six days to the good before the eventful day. At first Frank seemed cheered by this information, saying
that he did not care how long he was ; In for, provided he would be released In , time to celebrate his birthday. He '
lapsed into gloom In a short while, however, and when asked the cause replied that he wasn't so sure about being out September 24 after all. "Six days is a long time," said he, "and nobody knows what may happen in that time. I might begin to celebrate too early." There was no controverting this statement In view of Frank's past performances. HE WAS HAILED WITH JOY. When Frank showed up at the Jail he was hailed with joy by a number of other regular boarders, including his old pal, J. H. Gallagher, and 'Robert Patten of the Harbor, and Peg-leg Murphy Of Gary all of whom spend the majority of their time at this resort, with an occasional vacation just to add to their appreciation of the comforts provided for them there.
