were produced and admitted; these show he is not an alien. The evidence conclusively convinces the court that he had been domiciled in Calumet township and In the same voting precinct for five years. He is found to be a voter. NO. 83. JAMES H. GOADE Challenged on domicile. The two witnesses regarding this man are Arthur L. Russell of Griffith, and Fred II. Brooks, an operator then of Griffith and now of Cacanaugh. Both witnesses testified that Goade voted in the fall of 1806 in Calumet township. Russell testified he was there and taught school in the years '06, '07 and '07-'08 and continued until the summer of 1908. Without further detail, the developments In the evidence of Brooks while, on the stand are such that the court has no hesitancy In saying the reraonstrators have sustained the burden of the issue as recards Goade.

The witnesses testify that BAUDRY went to Gary the first week of October, 1907; that his wife was a waitress In McNally's restaurant; that they lived upstairs on a street on which one of the witnesses also resided; that he continued to live there until after the 1st of May, 1908. and hence Is a ' voter. whether he still resides In Gary or not. He was a voter on the 1st day of

May, 1908. A presumption may arise that his residence is wUh his family, but that DreanmDtion may be overcome by evi

dence showing the fact to be otherwise,

HENRY CARPENTER testified that

GRIFFITH built a shack across from his store, where he resided' for some

time; that he knew him continuously from December, 1906, or January, 1907, until after the 1st of May, and saw him the last time about March of 1909.

C. H. K LIBER testified on May 1st. 1908. GRIFFITH lived on Euclid avenue In Gary, where he had lived since January or February, 1907; that be continued to reside in that location until after the 1st day of May, 1908; that he left Gary "between two days."

REV. GEORGE E. DEUEL, testified Griffith resided in GARY from a time earlier than September or October of 1907 until later than May 1st, 1908. C. O. HOLMES testified that he worked on Broadway in the summer of

1907; continued there the summer of 1908 working and left the latter part of the summer of 1908. FRED J. CORSTINA testified that h knew GRIFFITH to reside in a shack, on Euclid avenue from the latter part of 1907 until October or November of 1908; he remembered the first above date by reason of a talk had 'with Griffith regarding a certain contract. WILLIAM MAY testified that he was present with Carl Shafer when the card was signed; that he told Lohman the nature of the business and the purpose of the cards; that Lohman said he was opposed to saloons and was willing to sign; the card was signed In their presence and handed back. On cross-examination he stated the card was signed by either the husband or the wife; the card was handed into the room and he did not know what Lohman did while the card was In the room, but his impression is that Mrs. Lohman signed the card at the window. Shafer handed the card in and she took it, but he does not remember who handed the card back. CARL SHAFER testifies that after

an explanation of their business Lohman said that saloons did a great harm
