Governor Marshall has come to the conclusion that whether gambling, prize fighting or the illegal sale ot liquor can be stopped depends entirely upon the sentiment of the community. The governor has been giving considerable attention to this question lately, as a result of investigations at French Lick. South Bend and Indianapolis. Jn his inaugural address the governor declared that law enforcement cannot go beyond what the temper of the community demands, and the results of the recent investigations bear him out In his contention. For Instance, It la next to impossible to convict a person of gambling in French Lick, because the people of that community are not strongly opposed to gambling; It la almost Impossible to convict a person of prise fighting in South Bend, because the people there apparently want prie fighting; and It is next to Impossible to stop Illegal sale of liquor in a place llko Fort , Wayne, because the people there are not so strongly opposed to Sunday selling. jury, Judge of Law and-Evidence. outstanding, and2am informed by Prose cutor Frank Houston that they will all be tried in due time, and I shall Instruct the attorney general to assist Mr. Houston. But if Orange county Juries will not convict, if they choose to Judge the law and the evidence in such a way as to enable the game keepers to continue what are we to do? The law makes me chief executive of the state, but It does not constitute me a Jury to Judge the law and evidence. State va. Prize Fighting. "A like condition exists in a number of communities of the state concerning prlae fighting and boxing. If this of nee obtains any information mat a prize fight has been held, the promo ters will be prosecuted. But we cannot go beyond a vigorous prosecution. for the ultimate outcome lies in the Jianda of a Jury, and if it is a Jury made up of men representing the sentiment of a community which is in fa vor, by a majority, or boxing contests, the Jury is pretty likely to Judge the law and tha evidence according to the Bentiment of the community. However, I am going to aid the prosecutors in placing the cases before the Juries, wherever they need my assistance; beyond that the governor is as power less as the lowiest man in the state. "I believe the statute concerning boxing and prize fighting is faulty, in that it does not clearly define what hall constitute prize fighting. It leaves too much to the Jury. It ought to say this or that, according to the definitions of the law, constitute a prize fight, and prosecutions and conviction in cases of violations would be easy. The general assembly at the next session ought to remedy the tatute In this respect; it would do away with all of the trouble we are now having about prize fighting. "What is true of prize fighting and gambling is true of illegal sales of liquor. If the community in which the action is brought against violators is In favor of the sale of liquors even during forbidden hours, and prosecutions are taken before Juries which decide according to the sympathies of the communities, under the constitution of the state, it is powerless." TAG DAY East Chicago People Will Contribute Toward Enterprise May 15. (Special to The Times.) East Chicago, Ind May 12. Saturday, May IS, has been chosen for East Chicago's library tag day, and is is expected that vry man. woman and child who ventures out on that occasion with any loose change concealed about his or her person will be deprived of it before the day is out. The ladies of the Tuesday Reading club are the ones who will command pedestrians to stand and deliver, but the idea of a library tag day did not originate with them. The scheme was developed in the fertile brain of Mrs. Abe Ottenheimer, who met with the Reading club yesterday in its rooms in the city hall and discussed the matter with the members. Every club woman is enthusiastic over the project, and is pledged to lend her assistance to the cause, and it is expected that a goodly sum will be realized toward starting the new library. Another meeting, to perfect arrangements, will be held on, Friday, Mrs. Ottenheimer meeting with the organization as yesterday and lending her aid to the cause. To this every citizen in East Chicago, who is in terested in the library, Is invited. The hour is 3 p. m. Testerday's meeting of the Tuesday Reading club was an . interesting one, there being three women who con tributed excellent papers to the pro gram. Mrs. William Pulllng's subject was 'The Wives of Nations," Mrs. A. H. W. Johnson gave a talk on "Esperanto," and Mrs. J. D. Kennedy took as the subject of her paper Nathan Haw (home's novel, "The Scarlet Letter." Ruling Spirit Strong. Instances of the ruling passion strong in death are very common.
