New York, July 12. The stock market seems to be in a waiting moorl. Traders as a rulo arc rather timid about committing themselves very strongly to either side of tiie market. Developments in the controversy between the United States and Japan are practically at a standstill. This condition of affairs has a tendency to keep the trading public, out of the market as well as the professional element. Today's ran ye of prices did not exceed one point for any of the active issues with the exception of Union Pacific which had a range of a point arid a half. At no time during the session was there any pronounced decree of weakness or strength. A glance at the closing prices this evf -ning will .show a fain, in the active list of about one-half point compared with yesterday's final sales. Tin street generally expresses apprehension over the success of the flotation of the new bond issue of the Union Pacific company. At the same time traders are afraid to go short of the Union Pacific stock, the risk looks too venturesome. Harriman's ability as a manipulator is too well known and greatly feared, as a consequence, the average- stock trader prefers to allow Union Pacific shares to drift for themselves. The Northern Pacific statement for June shows an increase in gross of 1G per cent. The cotton market closed a trifle lower on favorable crop reports. This was In a measure influential in Riving a stronger undertone to the cotton carrying roads. Forecasts as to the bank statement tomorrow seem to be uniformly bad. It is ilgured that there will bo a large loss in the cash item, but the surplus reserve will show a slight increase. The market closed dull and uninteresting.

CHICAGO LETTEE. Chicago. July 12. WHEAT At the closo tonight shows a fair recovery from the slump yesterday and early this morning. Prices at one time showed an additional loss of a cent a bushel compared with yesterday's final figures. September wheat sold down to 92 4 from an opening around 93 4. t subsequently raillied sharply closing strong at !)4 cents. On the early decline exporters took advantage of the weakness to pick up quite a line of cash wheat, a large export business was reported. This started pit shorts and professional beats to covering wheat put out at higher prices and brought the rally. Houses with northwestern connections were fair buyers on the break. There was a noticeable absence of bug stories from that section of the country, in its stead, several telegrams reporting red rust were received. Oother messages state! the crop was at least three weeks backward and weedy. A sprinkling of new wheat from the southwest is beginning to arrive. The quality is said to be about an average. CORN Ruled weak during the early part of the session, later regaining all
of the lost ground and closing steady at about yesterday's prices. The fine weather throughout the corn belt combined with a poor shipping demand was the bear features. The market closed steady. OATS Followed in the path of other grains, weak early and strong in the bast hour. Considerable damage reports emanating from the northwest accompanied with liberal buying orders turned the tide in this cereal. Closing prices were about the best of the session.
1'HODICE MARKETS.
Chicago. July 12. Strawberries, in fact, berries of all kinds were scarce this morning, oniy 2,500 cases all told being received. Although only a few buyers appeared on the market, dealers managed to (lean up ioiig before midday at outside prices. For eggs an active demand existed, with supplies small and prices strongly held. The butter market also had a strong undertone, supplies falsing short of requirements. .An unsettbd feeling again pervaded the potato market. The demand however, was somewhat improved and prices did not weaken perceptibly. There were three cars of poultry on the market, but the demand was good and the market charo-d up well at former prices. Veal also sotd readily at yesterday's prices. Quotations on round lots ranged: Hotter Receipts, 9,536 tubs. Extra creamery, jobbing, 24c; price to retail dealers, 254c; prints, 204c; firsts, 21 6i.22 4o; seconds, 19"d20c; dairies. Cooleys, 21c; firsts, 18c; renovated, 20 fry 2ic; packing stock, 1 So. Eggs Receipts, 10,353 cases. Miscellaneous lots as received from the country, cases returned. 13c; cases included, 134c; firsts, packed in new whitevvood cases, grading 45 per cent fresh, 13e; prime firsts. packed in whitewood cases, grading f0 per cent fresh stock, 14c; extra, high grade stock, grading 80 per cent fresh especially packed for city trade. 18 fee Potatoes Receipts, five cars; good

Traders who can watch the tape can buy stocks on reactions and should take advantage of all fair rallies.
Until the rights of corporations are clearly defined by the courts of last resort, we do not believe confidence can be established in securities.
Some of the Boston houses have bought A. C. P., and it is now very firm at 4 ft 4. without a great deal either way. Whole market acts strong.
Puy Copper. The Japanese government has apologized for the admiral. Our sailors can fight and dance, too. All kinds of of bear dope yesterday; none of it confirmed today.
For the time being, however, trust ami railroad prosecution will keep investors out of the market, and the speculative part is left to the manipulators.
After careful consideration of the government crop report, Ave think with the increased prices of all cereals the net result is very beneficial to the country at large and must in time have a favorable influence upon securities.
Trading in general is too professional at present and there is very little tendency either way, and all one can say Is that the good securities ought to be cheap enough for investors at about the present level.
It is the general accepted theory that the present state of depression is duo to the growing socialistic tendencies of the masses, encouraged by the prosecution and position of corporate Interests by municipal, state and federal authorities.
Lawson bobbed up again today with his little ad; he ought to make good this time or forever hold his peace. He has quite a lot of shorts to help him in the market this time, especially in Union, St. Taul and Reading. Buy them on all weak spots.
After the opening the market showed some recovery and prices rallied about from half to one per cent from last night's close, but under heavy selling of Reading and Union Pacific, prices throughout the list receded to the low level of yesterday.
The Interests that control the Colorado Southern road are telling their friends to buy the second preferred; the stock is paying 4 per cent, selling around 45; it pays the investor about 9 per cent, and the earnings are so great that a dividend will probably be paid on the common before the end of the year.
Washington reports are that "the powers behind the throne" are greatly surprised at the action of the market antl the newspaper tone of ridicule on the latest "trust busting" as applied to the tobacco company. The manly reply of Duke in answer had a very good influence. The feeling here is that the market is over-sold.

A reduction in general business to a moderate extent would, in the opinion of experts, be beneficial, as it would make possible inauguration of much needed economies in railroad operating departments. If the facts are as above stated, and the deduction correct, it is evident therefore, that the continued apathy on the part of investors is due to causes other than fundamental conditions.
Intrinsicly securities are admittedly cheaper. Without an important exception, the investment returns today on bonds and stocks is greater and the margin of safety larger than at any time ia a score or more of years. Many of the most important railroads today show surpluses of twice the dividend payments and in some in
stances three times or more. L'p to the
present there is no Indication of any
marked falling off In railroad earnings
and it is the opinion of those in a position to know that even if general
business should show a considerable falling off it would not materially lessen the net returns of the railroads. It is also the belief that the higher prices now ruling will fully eompensa:e the farmer and the country at large for the shortness in the crops.
