JURY HUNT STILL 01!
Court at Boise Hopes, However, to Secure One by the Week's End.
TEN TALESMEN SO FAR CHOSEH
Ttey Have Yet to Meet the Peremptory Challenge.
Darrow a Solemn Inquirer Two Men Ilejected for Their Opposition io Circumstantial Kvidence,
Boise, Ida., May 15. Substantial projrres.s toward the formation of a jury to trial William D. Haywood for tho allowed murdor of Frank Steunenberg was made on the third clay of tho trial. The selection of talesmen halted for three solid hours over chairs No. 5 end G, but once those seats had been filled progress was very rapid. At adjournment for the day counsel for the defense had completed the examination and temporarily passed the tenth talesman. They had but two more to examine-in-chief, and a reservation to examine, If they desire to exercise the right, two of thoe temporarily passed, so with reasonable process the twelfth talesman should be passed today in time to open the way for the hist peremptory challenge wnose exercise marks entry to the final stage of the formation of the jury. "Would Bar a Militiaman. Counsel for the state still adhere to the belief that the jury will be completed by Saturday. Clarence Darrow and Edgar Wilson, for the defense, divided the work of examining talesmen and their questions took the same wide range outlined by their associate, Richardson, and freely sanctioned by Judge Fremont Wood. Wilson added to the long train of connections, readings, Influences and association that might tend to disqualify a juror that of membership in the Idaho militia, which at various time has been called upon to quell the strike disorders. The examination failed, however, to disclose any military men among the talesmen. Darrows' Ijine of Attack. Darrow devoted much attention to the subject of prospective jurors, and his attitude and inquiry was earnest to the point of solemnity. He gravely invited each standing talesman who passed through his hands to place himself mentally in the serious position of the prisoner, and then to honestly ask himself if he would care to be tried by twelve men of minds framed Ilk his own.

Two of Them AYon't Convict on Circumstantial Evidence. Two of the original panel J. L-. Waggoner, who figured in the Yost affair, and George Walker went out for bias, and four of the special venire failed for various reasons to qualify. Two of the latter swore that they were so opposed to circumstantial evidence
m a capital case that thev would re-
fuse to convict on it, however strong it might prove to be. Another of the special veniremen got off for sickness, but there remain more than fifty c f thi special venire unexamined and ready to fill vacancies, making the chances of completing the jury from the special venire seem very good. It was another business-like session of the court, unmarked by important incident not connected with the examination of talesmen. Counsel bristled occasionally in a manner that indicated the spirit of the battle that is to come, but they continued in harmony nnd were generally courteous and graceful to one another. The court room is filled at all times, but the crowd is a changing one and it cannot be held unless the baiting of jurors makes it worth while. There were more women present than on any other day, but at that the number is scarcely exceeded a dozen. The women of Boise seem to be determined to avoid the trial. Mrs. Adams came again, and this time took a seat beside Mrs. Haywood, inside the? railed enclosure. She remained with the invalid woman all afternoon, and assisted in taking her from the room after adjournment. She and her hus band are down as witnesses for the stale, but this action is taken as a clear indication of her attitude. Tn seeking the removal of a talesman who Is not in god health Edgar Wilson, for the defense, made the statement that the trial would occupy several weeks, and possibly several months; and in questioning the talesmen counsel for the state admitted that most of the evidence for the prosecution will be circumstantial.
