Representative negroes of the south, on behalf of their race, have complained to the interstate commerce commission of the me by railroads of the south of 'Jim Crow" cars for interstate passengers, and have requested the commission to investigate the subject and, on the development of the facts, to issue an order compelling the railroads not to discriminate against negroes on account of their color. The argument was caused by the objection of the attorneys for the Standard to the character of evidence sought to be placed before the jury by the prosecution. She had also acted as Rice's private secretary, and was the executrix of his estate. She produced at the request of Attorney Phelps the certi'icates of original trust stock owned by Rice, the certificates of "legal title" into which these were later transferred, and scrip showing title to fractional shares of stock in all of the twenty subsidiary companies of the original trust. The text of these certificates was read into the record, and Mrs. Butts exused. the defense not caring to cross-examine her. Final Wrangle of the Day. The final wrangle of the day then began and lasted until adjournment. It resulted when Thelps offered as eyidence a certified copy of the record in the office of the secretary of the state of New Jersey, showing that in lsns the Standard Oil company of that

At the Georgia home-coming exercises here Governor-Elect Hoke Smith delivered an address on the race question in the south in which he said that the fourteenth amendment to the constitution binders the most intelligent mode of handling the subject. "Our national government," Governor-Elect Smith said, '"has always legislated for the Indians, placing around them restrictions entirely different from those applied to white men. But for the fourteenth amendment to the constitution

Why It Opposes the Introduction of the "Ancient History." The objection of the defense to the character of evidence brought forward

was mainly on the ground that the prosecution was going entirely outside of the case as set forth in the information filed by County Prosecutor David. Besides this the authenticity of the evidence in all cases was questioned. The general answer to these objections was made by Attorney General Ellis, who made his first appearance as an active participant in the prosecution, and by Attorney Phelps. The defense was

j taken care of by Attorneys Elliott, ; Inline, Troup and Tolles, Kline and , Troup doing the greater part of the I talking. Answering the objection of Kline I that the prosecution was going outside S the pleading on the case Phelps said ; the Valentine law, under which the ; suit was brought, was as broad as the ' world and as strong as Sampson; that under it there wasnonecessity of proving any trust agreements or naming

the parties in any trade conspiracy. It was enough to show the result of that conspiracy. However. It was the intention of the prosecution to show that the nineimen who formed originally the Standard Oil trust of 1SS have ever since at least all of them who are living continued to dominate the oil industry of the state; that they i abandoned the trust agreement when compelled to do so by the state only to enter another form in New Jersey,

which now continue. . Kline opposed this with the asser-

i tion that there was no law prohlbirI ing stockholders of the Standard Oil i Company of Ohio from selling their

! stock to a New Jersey corporation. He

further pointed out that the subsidiary companies named in the complaint were all declared by the prosecution, to be under the same ownership; hence how could there be a conspiracy such a? is condemned by the Valentine antitrust law. The right of the New Jersey company to own the stock of any other company, he said, could not be questioned in an Ohio court, and he asserted that the only evidence which was competent for the prosecution to bring forward was evidence showing a conspiracy against trade by these defendant companies in Hancock county, o.
