May Appeal Conviction Of Badgley, Brown
Attorney For Brown Says He Will File Appeals With U.S. Court Today An attorney for Robert Brown, under sentence with Frank Badgley for the slayings of two Hammond policemen, said he would file a petition Monday with the Indiana Supreme court seeking to appeal the two convictions to the U. S. Supreme court. Brown and Badgley, both formerly of Indianapolis, were sentenced to death for the killing of Officers Donald Cook and John Gerka of Hammond on Jan. 11, 1947.. The Indiana Supreme court refused to grant a rehearing of its previous decision affirming the conviction, but granted Badgley’s attorney an appeal to the U.S. high court. The attorney for Brown is Robert Buhler, of Ft. Wayne, who said that his petition would ask that the two appeals be consolidated and go to the Supreme court as a single case.
