He walked down the room to where Judge Terry sat, and, addressing him, asked why his wife had left the table. "Judge Field is here," observed Mr. Stackpote, '"and do you think your wife would be so indiscreet as to cause trouble!" 'Why do you ask that question?" said Terry. 'Because I do not wish to have any trouble here," was the answer. "I don't know," siid Judge Terry, quietly; and then he added significantly : "There might be trouble." The Southern Overland train arrived at tho station in O.ikhmd shortly after cloven o'clock yesterday morning. A great crowd had collected, telegraphic intelligence of the Lathrop tragedy having preceded the arrival of tho train, and the sleeping car in which Justica Field was sitting was at once besieged by United Statos officials and newspapermen. Justice Field maintained his quiet demeanor, and narrated to a, press representative the following j particulars of the shooting: 'I can tell you the story in n few words. For the last few months all manner of reports, both public and personal, have reached nu tlwt Judge Torry had threatened to subject me to some indignity if he should happen to meet mo. This fact caused the U niled States marshal to decide to provide such protection as he could during my stay In this State. Wheu I started for Los Angeles to hold court. Deputy Nagle accompanied me. He seemed to be a quiet, gentlemanly official, though I only met him twice whll away from Angeles. He asked me in that city when I intended to return, and accompanied me, taking a seat in the sleeping-car opposite tome. We heard,, this morning that Judge Terry and bis wife wore ou tho train, but paid no attention to the fact. When we arrived at Lathrop wo entered the eating station to get breakfast. I took a cent at the end of the table. Nagle sat ou one side of me.. Terry and his wite came luto the room soon aftor. As oon as Mrs. Terry saw nie die went onto the room, as 1 afterward learned, returning to the car for her sachel. Judge Terry arose, aud I supposed he intended accompanying her. Instead of doing so, hewalked back of me, and struck me a heavy slap In the face. I was completely astonished, ajid seeing he was m-tklug ready to strike again, Nagia cried out: "Stop, stop," but Terry did not desist, aud as he was raising his arm a second time, Nagle shot at him, tho bullet entering his heart. Hi fell to tho floor, Nagle shooting h second time, but the second shot uot striding him. Nagle was arrested at Tracy it ml takon to. ...ickton to await tho result of tin inquest. That is the complete story so far us 1 am aware of the facts." Protection was tiecordod to JusticeField, it is claimed, by authority of United States Attorney-Onneral Miller, who telegraphed from Washington to the marshal of tho district to seu that trieporsou of th Justice was protected nt all hazard, Tho order extended also to Judge Sawyer, of the United States Circuit Court In this city, upon whom Mrs. Terry made n pcrsonul assault lait year, while on a railway train accompanied by Judgo Tony. The order was based upon this fnct and upon threats declared to have been openly mado by Terry against Justice Field. Deputy Mnrdinl Nagle was directed to accompany Justice Field under this ordor. and is said to have given Judgo Terry full warning to stop when the 1b tter began his attack upon .fustic? Field, aud fired at Terry as the latter wns about to strikw a second time. Justico Field tuft tho Overland train at the Oakland ferry, and drove nt onco to tho Palaw Hotel, whero ho was joined by his wife.
