COURT HOUSE NEWS IN BRIEF
Interesting Paragraphs From the Various Departments OF JASPER COUNTY CAPITOL The Legal News Epitomized—Together with Other Notes Gathered from the Several County Offices. A, D. Hershman of Gillam and William Hershman of Walker town-, ship were in the city on business Monday. New suits filed: No. 8697. Alva D. Hershman vs. Jesse Nichols et al; petition for recount of votes of Jasper county for the office of clerk of the circuit court. No. 8698. William T. Hankins, vs. Town of Gifford; petition to vacate Auter street in said town.
James H. Chapman, attorney for Alva D. Hershman, on Friday withdrew their petition asking for a recount of the votes cast for the office of county clerk at the recent election, presumably on account of faulty service of the papers notifying Jesse Nichols of the action. Mr. Nichols also withdrew his affidavit asking for a change of judge. Mr. Chapman later filed a new petition for a recount, and the same will come up for hearing next Friday. Webb Hyatt and wife who completed laying out theiit fine and costs on the charge of intoxication last Wednesday and were released, were taken out to the county poor farm yesterday. Hyatt, who seems to be somewhat unbalanced mentally, was put back in jail Sunday. He is an old soldier and draws a good pension. If they can be taken care of there, it would seem that he and his wife should be sent to the soldiers’ home rather than to the county farm.
A few of the county candidates have filed their expense accounts with the county clerk. It is necessary for all to do this within thirty days following the election, no matter whether they were elected or not. -The reports of the Republican candidates who have thus ’far filed indicate that the Republican county committee had a pretty good sized campaign fund again. George W. Scott, their candidate for recorder, spent $58.65, SSO of which went to the county committee?-Jesse Nichols, for clerk, spent $64.70, SSO of which went •to the county committee; Edgar D. Nesbitt, for surveyor, spent $45, S4O of which went to the county committee; Reuben Hess, for prosecutor, spent nothing. This is all the Republican candidates who t ’have reported at this writing. Of the Democrats reporting A. D. Hershman; for clerk, spent $30.36, $6 of which was for cards, sll.ll for gasoline and $13.25 for meals; Robert J. Yeoman, for commissioner, spent $28.25, s>lß of which was
for gasoline and oil, $5 for meals and $5.25 for cards and, advertising; C. A. Tuteur, for prosecutor, and Dr. Rainier, -for coroner, spent nothing. On the Prohibition ticket, Fred H. Beard, John Norman and Charles Leavel, the only ones thus far reporting, spent nothing. As usual, however, this ticket assisted the Republicans in defeating the Democratic ticket.
Sheriff McColly and deputy, L. A. Harmon, were called up to- the Overacker farm northwest of Demotte Sunday *night, or, rather, about ? o’clock Monday morning, by 'the theft of a lot of furs that had been stolen that night from a man named Caise, on the Overacker farm. Caise saw the two thieves and took a few shots at them, apparently without effect, although the shots no doubt prompted the men to finally abandon their plunder. The furs stolen consisted of 313 muskrat hides, worth about SIOO. A few of the hides were found not far from the scene where the thieves had dropped them, and nearly all the balance were found still farther away. All but nine of the skins were recovered. While suspicion is directed toward certain parties in that vicinity, there is not sufficient evidence to warrant their arrest at this writing.
