Firsl marriage for each. Special Judge Marvin came over from Monticello Monday and the hearing of the Ryan ditch case was set for Dec. 4, which is tlhe last day or our regular November term. The hearing will probably consume several weeks’ time.
Mrs. Louis Jamison and children, formerly of southeast Marion, who have been at the poor farm here lor the past few weeks, following the unsuccessful attempt to get them over into Canada, Where her husband has enlisted in the army, was again started Monday on assurances that they would now be admitted, deputy John Robinson accompanying them as far as Hammond for Sheriff McColly. John McConnell vs. John Herr; suit on contract, motion for making of arguments for a new trial today was granted Wednesday, The L. W. Hubbell Fertilizer Co. vs. Jarmer D. Wells; on account and attachment; dismissed. Wiley F. Baker vs. Indiana O.* and Asphalt Company et al; title to certain real estate in Jasper county, quieted in plaintiff. Saranah and Donald J. Swan vs. James M. Pritchett; for foreclosure, dismissed as to defendants William Babcock and Albert Hopkins Wednesday and defendant, Pritchett was ruled to file answer by first day of next term of court. Last will and testament of William H. Townsend, filed and admitted to probate; Eva J. Rhoades, daughter of decedent, appointed administratrix and bond in sum of $2,500 accepted by clerk of court on July 23, approved October 11. The case of the State vs. Charles C. Parks, driver of a school hack in Newton tp., who was arrected last week for slapping the 11-year-old daughter of Ed McFadden of Newton tp., after having caused McFadden's arest and fine on charge of provoke, was tried before Squire Spitler Saturday and found not guilty of assault and battery, as charged. The girl was one of the pupils transported by Parks, and he had occasion to reprimand her for her behavior on different occasions, he alleged, and on one occasion slapped •her. The case against Mrs. Joe Shinriler, also of Newton tp., who was charged with provoke by Lewis Whicker, was dismissed by Squire Spitler on a plea in abatement filed by the defendant, who set up that the court had no jurisdiction; that a charge of this kind could only be brought before a justice of the peace in the township where the alleged crime was committed. Therefore if Mr. Whicker desires to push the case further, it will be necessary for him to file his affidavit in the circuit court.
