Ruling Favors “Jitney Bus.”

Indianapolis, Nov. 2- —Judge A. E. Anderson of the United States district court, yesterday overruled the motion of the Fidelity Trust Company asking the federal court for a temporary injunction against the “jitney bus’ drivers of Terre Haute, on the ground that the 5 cent automobile fare business was interferring with the franchise rights held by the Terre Haute, Indiana & Eastern Traction Company. An injunction was asked Oct. 20 and, on the answer of the defendants, a second motion to enjoin the automobile drivers was asked Oct. 25. The defendants said that the government could regulate and tax, but not prohibit the business of a common carrier aind that the power to prosecute regulations should come from a legislative body. The plaintiffs filed a dismissal in the court yesterday asking that forty-two of the defendants be released from the complaint.
