•Judge Paris Says Clause Compelling Candidates to Pay Fees Is Un-, constitutional. New Albany, Ind., Oct, 28.—With* the exception of one section, No. 13, of the new primary election law, in regard to the payment of fees by candidates for office, the constitutionality of the law, passed by the last general assembly, was upheld in an opnilon delivered this morning by Judge J. W. Paris, in the Floyd circuit court. The suit to test the law was filed by Charles D. Kelso, an attorney of this city, the defendants.being Homer L. Cook, secretary ,of state, A. V. Johnson, clerk of Floyd county, and Julian T. Miller, county auditor. Mr. Kelso sought an Injunction to restrain the defendants from carrying out the provisions of the law. In the argument before Judge Paris last week, the state was represented by Evan B. Stotsenburg, of this city; Abram Simmons, of Bluffton, and Leslie B. Naftzger, assistant in the office of R. M. Milburn, attorney general. Mr. Kelso was assisted by Addison C. Harris, of Indianapolis. The opinion of Judge Paris covered twenty-four typewritten pages.
