Another Echo of the McCoy Bank Failure.
The case of John C, Lowe, of Monon, against George A. Williams, of Rensselaer, was tried in the Carroll circuit court this week before a jury, and a verdict returned against Mr. Williams for the face of the check sued upon, $629, but cut out the interest amounting to something over S3OO more. The case grew out of the McCoy bank failure here, away back in April, 1904, when Mr. Lowe, who was in Rensselaer the Saturday preceding the hank failure—-or in fact on the last day the bank did business—in closing up a business matter in which the firm of Baughman & Williams were attorneys and $629 was paid to* Mr, Lowe by a check on the McCoy bank. Lowe did not get the < heck cashed here, but took it home with him and deposited in the bank there. The check of course was never paid because of the bpnk not again opening its doors. Lowe brought suit for the full amount of the check againßt Baughman & Williams, and a judgment was secured against them but was reversed * by the higher court. Action was then begun against Williams, and the matter has been dragging along through the courts all these i years. Mr. Williams had given Mr. Lowe his personal chech for the amount at. the time, as no account was carried in the firm's name, and therefore the latter case was brougat against Williams personally. Mr. Williams had offered to pay Lowe the $302 dividends received from the McCoy estate, but the latter wouiu never accept same, however. In the trial just ended, this amount was paid into court as tender to Lowe. The interrogatories submitted to the jury were answered in favor of Williams, and it is possible that the parties wiil —now get together and settle the matter without any further litigation. 1
