REMAINS COUNTY ASSESSOR. John Z. Johnson's Possession Upheld by Supreme Court. A judgment upholding John Z. Johnson in his possession of the office of county assessor of Newton county, fdr which he was a candidate on the Republican ticket, and received a majority of the votes cast in 1906, was Wednesday affirmed by the supreme court. The opposing candidate, Thomas L. Davis, sued to obtain possession of the office- But the court says that whether Johnson was eligible or not, his opponent was clearly not elected, because he received less than a plurality of the votes cast, and It Is not shown that any of the voters intentionally threw away their votes by voting for Johnson With knowledge of his alleged in-eligibility. The court says that a suit brought by the prosecuting attorney would be the proper method of testing Johnson’s right to the office, but that if he were turned out there would merely be a vacancy, and Davis would not, for that reason, get the office.
