TELEPHONE CASE RULING
Circuit Court Decides Against Contentions of Prosecutor Hooton. Lebanon. Ind., Jan. s.—Judge W. H. Parr, of the Boone county circuit court, handed down his decision in the Indianapolis telephone cases. He ruled against the state in its suit to restrain the New' and the Indianapolis Telephone companies from entering into a new franchise with the city and decided that the two companies had not exceeded their chartered rights when the New Telephone company leased its plant to the Indianapolis Telephone company. He sustained the demurrer of the Indianapolis and New Telephone companies to the complaint filed by Prose cutor Hooton. O. B. Jameson and John W. Holtzman, who represented the state, announced that they would appeal the cases to the supreme court
