CIRCUIT COURT PROCEEDINGS.
Not very much of importance has been done in the circuit court this week. The jury heard two cases and was excused Thursday morning until Monday. One of the cases heard was the Messenger-Pen-wright case from near Sharon, wherein the former sued the latter on account of some land rented by his brother who later turned the lease over to him for S6O. Mrs. Penwright harvested the crop, claiming the lease had been forfeited by the party to whom it was leased. The jury gave Messenger a judgment for S2B. The other case was that of L. H. Meyers of Rensselaer against his former farm tenant Amos McCoy, now of near Lowell, wherein a note given plaintiff was sued upon. The note was for $421 and interest, but the defendant set up a counter claim and the Jury brought in a verdict for $55 for defendant. Other proceedings thus far are noted below: State vs. August Schreiber, a Roselawn saloon keeper, charged with keeping a gaming house; set for trial Third Monday, 11 a. m. Ditch petition of Horace Marble; commissioners file petition for additional time, and time extended to first day September term. Grover Smith ditch; set for hearing fourth Wednesday. James Lamson et al, ditch petition; commissioners given until April 25 to file report. Elizabeth Gangloff et al, ditch petition; commissioners file report and time given for objections, notice ordered for new parties, returnable April 29 and cause set for hearing at that time. Oliphant Hall vs. C. I. & L. Ry. Co., set for fourth Friday. John F. Judy vs. Charles Kramer et al; set for third Wednesday. Luther M. Fairbanks vs. H. B. Taber et al; cause dismissed, costs paid. John Thompson Co., vs. George Worden; defendant defaulted, judgment for $121.97. E. L. Williams ditch petition; continued for term. John Finn vs. Winifred Finn et al; set for hearing fourth Thursday. First National Bank vs. Dedrick Decker et al; set for second Monday, 9 a. m. John C. Lowe vs. William Overton; cause dismissed, costs paid. Lavina Bisher vs. Lura L. Bisher et al; set for April 30. Yeiter and Day vs. Fitz W. Bedford et al; cause dismissed, costs paid. William B. Austin vs. John Karr et al; cause dismissed, costs paid. John W. Humes et al petition for ditch; motion for new trial overruled and appeal taken to supreme court. * Levi Hawkins et al, vs. Board of Commissioners of Jasper county; demurrer to complaint sustained, plaintiff refusing to plead further, appeal to the appellate court.
