Otis and other petitioners on the 6th day of October. 1905, filed with the Judge of the Jasper Circuit Court, and in the Jasper Circuit Court their petition praying for the location and construction of a large open ditch on the following described route, to-wit; Commencing at a point thirty (30) feet north of the northeast corner of section twenty-three (23), township thirty-one (31) north, range seven (7) west in Jasper county, Indiana, and from thence west on a line thirty (30) feet north of the section line to the public ditch known as the Otis Ditch, thence following the line of the Otis Ditch to the one-half section line of section fifteen (15), thence west on a line thirty (30) feet north of the section line to apoint thirty feet north of the southwest corner of thesoutheast quarter of section seventeen (17) and from thence north to the center of section seventeen (17) and from thence in a general northerly direction following the line of the said Otis Ditch to a point in said Otis Ditch west of and near the center of section five (5) said township and range, where the same will have a good and sufficient* outlet, said ditch being wholly within the said county of Jasper and State of Indiana: that said ditch cause by order of court apd by endorsement on the petition therefor is set for docketing on Monday, November 13,1905, the same being the first judicial day of the November term, 1906, of the Jasper Circuit Court, and that you and each of you are hereby notified of the filing of said petition and the day set for docketing thereof and that your names and your lands are mentioned and described in said petition as being affected and which ought to be assessed for the construction of said improvement.
