LIBRARY BOARD WINS.
Judge Talbot of South Bend, came down Monday and rendered his decision in the Carnegie library tax matter, holding that the library board, under the statute of 1903, had the power to fix the levy; that if the city council had any authority under said act to make the levy it was under section 1, but that section 5 of the same act repeals the levying powers of the oouncil and places it in the hands of the library board. It will be remembered that the library board fixed the levy at one mill on the dollar for the Carnegie library, and that the city council ignored the board’s levy and fixed a levy of 8-10 of a mill. This would not raise sufficient revenue to meet Mr. Carnegie’s requirements, and the board brought proceedings in oourt to compel the. auditor to plaoe the levy as fixed by said board. The decision sustains the board’s action in the matter and the tax will be 1 mill on the dollar, unless an appeal is taken, which is not likely.
