THE CIRCUIT COURT.
The Collcewll vs. Price damage case from Barkley tp., was ended Friday evening, the jury giving a judgment for $lO to plaintiff. None of the jury is understood to have favored giving over $25 to plaintiff. The Aultman Taylor Co., vs. Franklin Gray et al; decision not rendered at this writing. The Makeever-Blankenbaker road case was begun Monday with Judge Nye of Winamac as’ special Judge. The case was quite a loug winded one, and went to the jury Tuesday evening. After being out for seven hours a verdict was returned in favor of Blankenbaker, the jury holding that Makeever would not be damaged by the location thereof. The case will probably be taken to the supreme court. Jacob Conrad vs. American Express Co.; change of venue taken by Express company to Newton county. Walter Clark vs. I. W. Warner.; dismissed by agreement of parties, Wenrick vs. Wenrick, action for divorce; decree granted on payment of costs. Duggins vs. Duggins, action for divorce; decree granted plaintiff on payment of costs, also custody of child. Lamborn vs. Farmers Mutual Insurance Co.; set for Dec. 5. Punter vs. Punter, divorce case; set for Dec. 5.
The state case against Wm. Bryant, a Kersey junk dealer, for larceny, was dismissed, it being shown that the prosecuting witness was a member of the grand jury that returned the indictment. C. E. Mills was special judge in this case. The cattle stealing cases were all continued. The injunction case of LaMoine vs. McGowan, Benbow and Munden, the recently elected justices of the peace of Union tp., was heard by E. B. Sellers of Monticello, special judge, and the case thrown out of court. The court intimated, we understand, that the proceedings were irregular; that injunction proceedings could only be brought where there was immediate danger; that LaMoine was in possession of the office and the thing for him to do was to hold on and let the other fellows do the fighting. Rial B. Harris and Moses Tuteur were appointed jury commissioners for the year 1903. The case of Thompson vs. Parkison, to enjoin the collection of the alleged omitted taxes placed on the duplicate by the tax-ferrets, is set for next Wednesday. It is expected that exSupreme Judge Timothy E. Howard of South Bend, will hear this case. He did not know definitely at this writing if he would be able to come, but thought he would. Judge Howard is probably the ablest judge in Indiana. The case of the town of Goodland vs. Perry was being heard by the judge as we go to press. About a dozen winesses are here from Goodland. A. D. Babcock and Wm. Darroch have Goodland’s side of the case, while Foltz, Spitler & Kurrie represent Mr. Perry. There is a dispute over the line of a sidewalk along Perry’s lots. Perry wanted to build on what he claimed was the line or not at all. The town built on what it claimed was the line. Perry refused to pay for it and the town sued.
