Huston vs. Fatka et al; White circuit court; set for oral argument Dec. 16. [This case orginated in this county and the parties to it still reside here. Ed.] J. Babcock, John Hann, John Martindale, Harvey E. Parkison, Walter V. Porter and Jay W. Williams qualified as members of the county council last Saturday, and organized by eleoting Frank J. Babcock for president and Harvey E. Parkison president pro tem. John F. Pettit of Walker tp., one of the newly elected conncilmen, failed to qualify. The following additional appropriations for 1902 and former years were made: Exp. election* 1900 ( 300 Advanced on ditches 500 00 Advanced on gravel road* 100 00 Books, etc., Iroquois ditch 40 00 Advanced on ditches 1.C90 00 No. 6405. The state of Indiana on the relation of John D. Sink, prosecuting attorney, vs. Samuel M. LaMoine. The complaint alleges that Union township is entitled to bat two justices of the peace, and that she has two duly qualified and acting J. P’s. in the person of James Wiseman and Thomas Fay; that on or about Oct. 12, 1901, the board of county commissioners appointed defendant and he was commisioned by the governor and has since been acting as justice of the peace for said township, and there being no vacancy he has since held the same unlawfully. Wherefore the court is prayed to require said defendant to show by what right, if any, he is assuming to act as justice of the peace, and that he be ousted from office. The complaint would indicate that the proceedings were brought because of LeMoine’s having begun action last week to enjoin the newly elected J. P’s. from taking their office by reason of three having been elected where only two should have been. No. 6406. Delos Thompson vs. William L.
