ABOUT CIRCUIT CLERKS.
On the strength of the report that the legislature erred in extending the term of office of “county clerk” instead of “clerk of the circuit coart,” says the Indianapolis Sentinel, about twenty clerks were elected in the state and put up campaign exSanses of probably SSOO each. In ass county Harry S. Elliott, a republican, was elected on the supposition that the term of the present incumbent, Julius F. Lienemann expired Nov. 5, 1904, three days prior to the election in that year. Eliott’s commission from the secretary of state is dated to commence Jan. 1, 1905. According to the constitution a man must be elected to an office at the first election prior to the commencement of his term of office, and there will be another election in November, 1904, which necessitates the election of another clerk. By the action of the state officers in dating Elliott’s commission they hold that the legislature did right in extending the term of clerks and that in their opinion, the supreme court will so decide. By the same action they hold that other clerks will have |p be elected in 190-1.
