FOR BREACH of CONTRACT.
Pulaski County Democrat: One thousand dollars for breach of contract is demanded from Alex Merica by John W. Burget, both of Francesville. In Mr. Burget’s complaint, just filed in circuit court, he sets forth that in March of 1900 he purchased of Alex Mercia and H. W. Bledso the safe, fixtures and good will of the Bank of Francesville, with a stipulation in the contract that Mr. Merica was not to start another bank in Francesville as long as Mr. Burget was the owner of the Bank of Francesville, and with a further stipulation that either party breaking the contract should forfeit SI,OOO to the other party. The complaint goes on to allege that about six weeks ago there was started in that town the State Bank of Francesville, of which Mr. Merica is a stock bolder and assistant cashier, and at present manager of the bank. Mr. Burget therefore demands the SI,OOO forfeit, S2OO attorney’s Jee and interest on the SI,OOO, isince March 5, 1900— the time of the bank purchase. C. W.
