OVERTON CASE DISMISSED.
The case of tlm State of Indiana vs. Parker Overton, appealed from Justice Troxell’s court, was dismissed by the circuit court for irregular proceedings in the lower court. It will be remembered that Mr. Overton, who teaches thi James school, south of town, was arrested some time ago for alleged brutal beating of a 10-year-old son of Frank Cochran, and tried before a jury in Esq. Troxell’s court. Ho was found guilty and fined SI.OO and costs, amountihg to $43.85 altogether. The case was appealed by defendant to the circuit court and the question of legality of proceedings in the lower court in the verbal uppointment of a special constable to mnke the arrest, was raised, and the court dismissed the case. It was stated that Overton had good grounds for a case for damages against both justice and constable, but the understanding was with his attorneys and the court that if the case was dismissed no action for damages would be instituted. Now. if the prosecuting witness desires to prosecute the case, it will all have to be done over agnin. It it said, however, that nothing further will be done.
