An Expensive Ten Dollars.
It will be observed that the county commissioners allowed a bill of §5 for Treasurer Gwin’s short-hand reporter in the case of Babcock vs Gwin in the lower court, and we strongly suspect that the bill of a Rensselaer law firm of $41.62 for “legal opinions,’’ which was continued for want of appropriation, is for services in this case. Neither should be paid, as it was clearly shown that the treasurer exceeded his authority in refusing to make receipt when Babcock offered to pay the alleged taxes under protest. Besides, the treasurer is paid for collecting de linquent taxes in fees, and if he exceeds his authority through personal animos the taxpayers of the county should not be expected to reimburse him for whatever costs he makes. The $lO unjust taxes which overzealous officils succeeded in collecting in this case, through apparent political prejudice, will, if attorney fees are allowed, cost Jasper county a round one hundred dollars.
