All the letters that passed between the scmdi ia this affair were published at the time in Cincinnati and Indianapolis newspapers, and they present a history of the eise entirely at variance with the statements tbe Delphi Journal. Tbe facts gathered from the correspondents of the "second?," and of some gentlemen who were personall cognizant of all that transpired, are timply these: . When Mr. HelTren received a note from Moody asking where, outsideof the State, a further communication would reach him, he handed it to his next friend and forthwith took a train for Cincinnati. Mr. M'xjdy waa in due time informed that Mr lleffren would be pie a-twl to receive a further communication from him at the Harriet llone in the city above mentioned. On the following day, which was Saturday, the expected challenge came and was promptly accepted. The weapons selected by Mr. Hrfire-n were rifles, the place a well-known valley a boat eight miles soutneast of Cjvinsn. in Kentucky, and the time the following Mouday morning at sunrise. It then became the duty of Mr. lleffren" 8 second to pro luce the gatm, from which Mr. Moody should choose the one that best pleased his far.cy. Tbe riflaj presented weighed fourteen pounds each, bnt Judge Milroy, on behalf of Mr. Moody, peremptorily refufcd to accept either of tbe weapon on account of tLeir weight. Two twelve pound rifles were then supplied, of tame make and caliber as the heavier gun?, with offer to Moody that he should select one of the four, leaving Mr. Heffren to Choose from the three that would remain This oUVr was refilled becau e. as alleged, the heavier gun which Mr HeöVen would - selfCt might carry a bullet (sixty yards) more steadily than tbe lighter rifle whci would be selected by Moody. These concessions cn the part of Mr. IlefTren were all in violation of the rules of the "code," bu he was determined that Moody should be aecommooatod; so he agreed that Mr. Moody should take one of the licht rifles and he would take the other. To the utter astonishment of Mr. lleffren and his friend, an answer then came back that Mr. Moody would not accopt any of the terms offered by Mr. Heffren. but that Heffren must take one of the light rifles offered and that Mr. Moody would use a gun of his own, which turned out to be a sort of a hybrid betweeu a shotgun and a ritle, with a caliber that would accommodatea ball weighing over an ounce. It was at this point that Mr. lleffren' g second advi.-seü him to publish Moody a a coward and return to Indianapolis. Judge Milroy spoke privately to Mr. Heffren'a eeeond about taking tbe fight upon himself, but he made no formal proposition to do so. Mr. Heffren was unwilling that Moody should have even so slight a pretext for getting out of a light which he had challenged. An answer was therefore dispatched to Mr. Moody tbvt he would be at liberty to make use of his own gun and that Mr. Heffren would accept the riße selected for him by Mr. Moody. The Monday morning came, with rain and thunder and lightning, and the Kentucky Clay ras half way up to thi horses' knees; bat tbe carriage containing the Heffren party arrived upon the ground selected for the combat at the appointed time and impatiently waited until after 9 o'clock for Moody and bin friends. Finally the latter party arrived, Mr. Moody looking as if be had "just arisen from an attack of typhoid fever. He was accompanied by Gereral Fitch and Maj r Terrell, the latter of whom informed Mr. Heffren'a second that to force Moody to tight would be nothing but murder, and be-zged that he should be "let down" as easily as possible. Accordingly a letter h dictated for Moody by Mr. Heffren'a second, in which Moody retracted the offensive language which had provoked Mr. Hetfren's retort, upon which Mr. Heffren's retort fell to the ground, whereupon Moody withdraw his challenge. These who were of Mr. KefTren's party, and especially hia second ia this affair, mot pitively assert that he (lleffren) was ready end more than willing to tischt from first to last, ard came home-deeplv chagrined that the affair had to cud in a fiasco. The Supreme Court rendered a decision to-day in which it ia held that the law of Alabama prohibit ing miscegenation is not in contact with the Fourteenth Amendment to the Constitu tion, or with civil rights legislation founded on it, for the reason that it applies the same punishment to notn offenders, white and blacic, witnout discrimination.
