How Merrick Bore Himself -Interview . with His Brother. " The Tnsorla on Which Hopes for a Ntw Trial Art Baea-A Rlic of Mrs. Msrrlck-Notei. Yesterday Prank Merrick, youngest broUier Tf WllK&m Merrick, presented hlmseir at the Jail for an interview. According to his story be la resident of an Inland town In HUnoU and was on hu retarn from New York, where he bnd been with a load of cattle. lie had not beard of bis brother for some years, and the first Intimation he bad of his arrant, trial as-d conviction, was when be endeavored to find him at the stable. The met tins: was not npeclally affecting, and In hit conversation made no special profler of aid and asMlntance. Aa the Interview closed tie said: "1 wish yon -could only walk out with me te-dayanyou used to do." To which the couteinued man replied : "Oh, I don't cure about it to-day. I i's too cold and damp caitslde." The brother visited the Jail tw-ce during the day and lea for home on the evening train. HOP3 FOR A RBW tJtlAL. Borne lawyers ore said to have expressed tat opinion that the. sapreir.e court will reversn the verdict in the Me-rrlea: cane on the itrouiitl that It does not specify under which count of the Indictment he ,1a found guilty. The verdict, which was published In yesterday tnurnlDg' Benlinei, . 1m as follows; "We, the Jury, llud the ' defendant gnllty of murder In the first degree, ns charged In the Indictment, aud that be suffer ti tat n therelor." It appears i hat the hupreme court hasdeciOed the iolot rcpetettly, holding such a verdict good in the follow. canes: Ixvell against the state, 46 Indiana report, prge biA); Euwrlaht against the state, 6.1 Indiana, page 5K7: Bl.sot against the feUte. 53 Indiana, page t0. The .ame rule has been held Kood in a number of other canes. One point, relied on by the defendant's counsel to secue anew trial was the relusitl of the court to compel the doctors to testify as expert. That point a as ruled on recently by the supreme court, and Judge Elliott in a civil salt In room 4 this week held that the rule applied to all persons called as experts. A KKLIC. Near where the body of Julia A. Merrick was found, on Eagle Creek, a scrap torn from one of the ctly papers was found. On the scrap was an extract from the Woman's Journal, whlcn was read to the Jury by Mayor Mitchell as a part of the argument, with the statement that be adopted it as his own language, and they not know where it came from. The extract Is as follows: Woman's Journal: 'No man will ever prosper who has the enrse of a ruined woman u won him. The murderer of the body can be tried and eiecn'ed by the world's laws, but the murderer of the soul is tried bv heaven's law, and tne execution is as sure as divine Justice.' Aunt Betsy said tbis as she folded the white bands of a beautiful girl, and put white flowers and green leaves about the marble cold forehead. There ws a tiuy babe b -side the girl mothfr. Tbe house was hushed and there was mourning such as few know. Half glad tb at the mother and child were dead, the rest of the family nius'. perlorm the last sad ofllce of burial and bear the family shame, A baunted house! A rulued home! uod the architect and man the spoiler. The curse is there, and thedeatroercu not escape." Notts. Merrick was Jut as cool and indifferent yesterday as ever. He was combed and brushed. and his clothing was as lau.Uessly arranged ss though expect line visitors. One of the attorneys in tbe Merrick case yesterday remarked that if he could have bad his way Merrick wouid not hare appeared on the -stand, as he hurt the case more than he helped it. Over th Hills to the Poor House. Ben Mason, a well known hotel man of this city In the olden time, went to the poor house this week. He kept the Hherman, the Palmer, now the Occidental, the Mason, now the Grand, and other hotels, winding np with B. Mason's Hotel on South Illinois street. He Is the father of Tyler Mason, the reformed drunkard, who is making quite a reputation as a temperance lecturer. Mr. Mason was one of the best known hotel men in Indiana, but now -he Isold. Mlsfor tune and au.vendty have been his. He spent the last cent be possessed in regaining his health, but with no possible means of making a living, the poor old man tbe other day asked permission to be sent to the poor house as the last avenue open to him he could not go upon the streets and beg. While being taken to the poor house, which , most be bis future home, he briefly recounted his life's history, for forty years he has Mved on tbe fat of the land and denied himself nothing. Years ago he left New York, went to. Fort Wayne where he accumulated some money in commercial purults, and from there moved to Lafayette, going from there to Muscatine, Iowa, and came here about the beginning of the war. He has made inouey, muoh more than many successful businessmen can ever hope to make, but he has seen thousands of dollars melt away In InJudicious peculations. In looking back over his life be says he sees nothing over wMch to shed a teer, us this is a life of ups and downs, and he 1ms been reduced fro u affluence U .poverty. When he came to this city ne took a position in the Sherman House, where be remained but a short time, when he Jormed a partnership with Uriuley and Henor and bought into the Palmer House, where he made a great dual of money. He afterwards sold out his interest to his partners, and with tbe bonus he obtained, f got control of the Sberman House. When he retired from tbe Kuerman he offered to bus- the Hpencer House, offering f75,0.l ca.h. Being unable to get this house, he opened two ho els. one in Martinsville aud one in ireensbnrg. In 1X70 be opened the Mawn House.; from which the tirand Ho el has grown. In one year be sold out to Thomas Baker for $),Uo, and this money haa been lost in speculation. Ueis66 yetrs of age, and as h haa paid as high as slio taxes, he is entitled to a "warm place in the poor house," as beexpresses it. The step be ban taken was well considered before the move was made. This brief history of a life in which a man is reduced from affluence to the pr house. Is but one the illustration of the truth of the saying Uiattrutn it ofUui stranger (bat fiction. . r i V; ' Educational 8 1 at: sties. , In tie forthcoming report of the superintendent of public instruction there will appear comparative table showing various items, a enumerated at tbeJaeadoi tbe col urns, from 1SU8 to 1878. inclusive.

Pro'es-sor Sruart is preparing an analysis of tbe above table, showing that the turning point of school expenses has been reached, and that if the legislators will now obty the cry of "band off," the expenditure on account of public education will be annually reduced. .. Cantlon to the Public To avoid imposition, purchasers of Wadtham watches will observe that every genuine watch, whether gold or silver, bears our trademark on both case and movement. Gold cases are stamped "A. W. Co." and guarantee certificates accompany them. Silver cases are stamped "Am. Watch Co., Walthsra, Mass , Sterling Silver," and are accompanied by guarantee certificates, signed IU E. Itobblns, Treasurer. The name ""Waltham" is plninly engraved upon all move ments, irrespective of other distinguishing marks. This caution is rendered necessary by rea son of the fact that onr cases are frequently separated from our movements and put upon worthless movements of other makers, and vice versa, thus affecting injuriously the performance of tbe? watches and vitiating our guarantee, which-is intended to cover only our complete watches wholly made by us. It is necessary ' also -because it is so notorious as to be a public scandal, that there is great fraud in tho metal quality of both pold and silver case a as now generally sold. We have demonstrated by frequent as?ays that many gold and silver ca'S offered in the market are debased from 10 to 20 per cent, from tbe quality they assume to be. This is a fraud upon the purchaser, and accounts for tbe low price at which such cased watches have been sold. "Eighteen carat" gold, such as the WaJtham cases are made ot, is as nearly pure gold as nan be made and ,be durable. It contains 750 lOW of pure gold and 2.30 1000 of alloy. Sterling Silver (English government standard) contains 925 1000 of pure silver end 751000 cf alloy. The Waltham Watches will always be found up to the standard represented.
