Warren Tate Fined $10,000 for Contempt of Court Judge Burns Sets an Example to Bulldozing Law Breakers. Tie Majesty of the Law Sustained With Rare Firmness. . Judge Bums, of the superior court, yesterday fined Warren Tate $10,000 for contempt of court by fatally shooting a witness during the progress of a trial. TBI COURT'S IKCISIOf. I agree with con use 1 on both skies that the only thing to be determined here is, how lar tbe rules governing the constitution, authority and decorum of the court have been infringed upon. I am now Informed that his altercation in part grew oat of the fact that there was home dltTereuce between them as to the mwtters about which be was testifying, viz.: in regaid to tne value of this land. Whether the opinion of the witness was right or wrong is not for me to determine or consider. But! say that witnesses and parties must be protected In their opinions as well as in their persons while they are in attendance upon court: especially so when they are brought In by the compulsory process of the court and held here, as was i be witness In the case. These, ihen, are the consequences that are Daturally likely to follow when deadly weapons are used In or about the court noose. Mr i messes and parties are likely to be Intimidated or likely to be deterred from giving expressions to their opinions while upon the witness stand. The Judgment of this court Is that Mr. Tate be fined ten thousand (Slu.OUU) dollars, to be collectable oat of any property that he may have tubject to execution. A PRECEDENT. It Is understood that defendant's attorneys will prepare and on Wednesday file exceptions to the ruling of the court and appeal to a higher tribunal. In this connection it may be remembered that Julge Perkins of the supreme court in a habeas corpus proceeding last summer announced that where a contempt had been committed another court would not interfere merely on the ground that the punishment was oppressive and excessive. In that case an administrator was seat to jail for failing to make a report to the at!sfaction of Judge Julian. A writ of habeas corpus was sworn out, and in the course of the proceedings Juige Perkins announced without reservation that where the conrt bad the right to punish for a contempt another court would not interfere merely because the punishment was excessive. VARIOUS REPORTS, It is arranged that Mr.-. Love, the widow of William Love, shall be appointed adnilnisistratix. The attorneys for the estate will then bring suit agafnst Tate or damages, which by statute are Hmiied.to $5,000. It is also understood that suit for libel will be commenced against the Ciccinnatti Enquirer. Senator Voorhees and Major Blackburn, of Cincinnati, whose defense of Patrick Bolan last rummer created such a senna tlon, have been retained to assist in the defense of Tate. STATE IN IE liLHIEN CE. It. C. Swann, an old nd respected citizen of Montpelier, died Saturday from diphtheria. One of the public schools of White county has been closed on account of the prevalence of scarlet fever. Judge Sleeth is not the oldest man, but the oldest citizen, of Shelbyville. He is still in hale good keeping. Richmond Independent: Iteld, Beeler& Co. purchased 1,677 hogs yesterday that averaged 325 pounds each. J. W. Brown, an alleged embezzler, from Lincoln, Nebraska, was arrested In Benton county Saturday afternoon. James Hurst, of Wlnamac, bad several of his ribs fractnred by a fall from his wagon while unloading fodder on Saturday. John McCormick, William 8mlth and William Murray, thre Cincinnati crooks were captured at New Albany Sunday. A $500 reward bas been offered for the arrest of Frank Gllimore, who murdered W. E. Ohio, one at Rochester, New York, and married an E.kburt lady some two years aiDce. Saturday evening Edward Frees, a retident of Terra Haute, was returning home from a day's hunt. While taking hi gun from a wseon it was accidentally discharged. ibe load taking effect in the face, killing him almost inttantly. Last Thursday afternoon a young but ma tore girl named Frances Overklnder, aged 14 years, stepdaughter of Fred Relnbard, a farmer living in Robinson township, Posey o unty, was seat out to pasture to drive the

A the neighborhood is filled with tramps, it is supposed that she was iove'gled into tbe woods and foully dealt with. It Is thought she was outraged, murdered and tbe body concealed, or that she was kidnapped for a worse fate. Tbe whole country about there Is aroused and excited. This Is within 10 miles of Mount Vernon, where tbe late lynching outrages occurred.

We have demonstrated by frequent assays that many gold and silver cases offered in tbe market are debbsed from 10 to 20 per cent, from the quality they assume to be. This is a fraud upon the purchaser, and accounts for the low price at which such cased wa'cbes have been sold. "Eighteen carat" gold, 6uch as the Walthara cases are made ot, is as marly pure gold as can be made and be durable. It contains 750 1000 of pure gold and 200 1000 of alloy.
