The American public are familiar with the bisrory of Goodyear and Ellas Howe, but in the rush of mi;hty events which have filled the minds of the people during the putt 20 year, they have not noticed the meager reports of the great struggles of this oue quiet, unassuming nisn, wjo left the plow haudles and the orderly life of a farmer to become a chieftain in litigation, and who, though seven times bankrupted in 20 years, has overthrown the combined forces of his enemies; but in the end has gained the eort or a victory which is almost defeat, because he now has le. money than he bad wben he first obtained his patent The inadequacy of our PATENT LAWS is also illustrated by the history of Mr. Eirilsell's litigation, as it demonstrates how little protection is in fact given to the inventors of rue.itorious labor-saving maChine?, and especially those which accomplish that which no labor had ever been ab:e to do as perftcly before. joas c. BIRDPEI.L, the principal of this litigation, was born in 1814 on a farm near West Henrietta. Monroe county. New York-. In 1S58, at the time of the granting of his patent, he lived at that place upon his own farm of 284 acre?, the whole of which was then valued at $33 000. Like other farmers, he bad experienced great difficulty ia threshing out clover seed, as the only way then known to separate the beads from the straw was to tramp them out under the feet of hors, or with fldils, and after- ; ward hulling the aeel in an imperfect ma chine then a Utile in use. These old pro cesses reqnired the frequent handling of the clover, which kept the price of teed beyond the reach of the smaller clasi of farmers. Ana at this time clover had become recogi7Pd ana ertit fertilizer, second only to sruino. and abont the only thing which could be nsed upon the broad acres of farms distant from the seaboard. SCGIR5I50 WORK. In the winter of 18556, and two years before this patent was granted, Mr. B;r.isell became satisfied that bis machine would separate the clover seed from the straw and huUs by one process, and he decided to begin their manufacture. lie accordingly erected works at West Henrietta, borrowing money and mortgaging bis property, and began the manufacture of machines, but the expense was so great and the public so incredulons that by 1859 he was $15,000 in debt. In 13G3 he became sat -fled that his field of operations wis in the wett, and in 1864 be removed the moat of his business to this place, leaving his account books and other property in charge of an agent at his old pUce. That fall his entire etUblishment at Wefct Henri etta, including office and books, was destroyed by fire, which ued up his asset in the shape of notes and other securities. This left his gross indebtedness about $23,000, but he pushed on with his work at South Bend, backed by a few friends who had faith in bis invention. The war was racing at the time, grain commanded fabulous prices, and tbe entire tarmiDglnterests neglected everything .for that kind of pro luce. In 18G3, while boarding, with bis fani'ly. at the St. Joseph Hotel here, that bulldn burned, destroying his books, papers and all of the assets and accounts outbids of the factory, and added again to hi debts. THE THIRD FIKX occurred in 1867, destroying a?am bis office and a part of his factory, which azain increased his indebtness. By 1870 his enure farm bad been invested in the buIne.s, arid he had still a d-bt of over $20 000 banging over him. During that yetrbe bad a fair business, but not sufficient to clear him of Indebtedness. IAWSC-TS AND INFRINGEMENTS. Daring all of his troubles and financial mbarras4ments different partita had been building machines under bis patent, but be was unable to cjpe with tbem, as tbey were generally rich corporations. In 1S63 he brought his firt suit against a company at JVliahawaukee. a town but four miles from here, and obtained a small iuigment. But in 1SG4 E. K. Colllus, of New York, bnugnt a suit aaii;st h in for infringement, which was dt c:dtd in favor of Mr. birdsell in 18Gt, but the liugaiiou had con him over $5 000 la the next three years he bad five suit, all against ix.r ul cuuuan.es; and though he was successful iu each, and bad them en twined, it cot him $20,000. besides tbe loss to his busine-a in having the market filled with machines, which, under bis patent, tbe government had guaranteed him tbe ex elusive ri:ht to make. And this did not ddter manufacturers from uiug his patent. i because they knvr it would expire in 1872 and they were prepired t-opeu upon the market as soon as uis exclusive privilege ex pired. It was known to them that he had but limited means an i would be driven out of the field by their money and established business connections. volumes of print, and COST BIXTT flVB TH0tTSAO DOLLARS, ( but the cases continued under appeals and the law's delays until 1374, when Judges Swayne and Welter gave a decision in favor of BirdselL This for a time stopped infringements, but two years of the time of bis extension were gone, and it was not until 1877 that he obtained a final decree against tbem. And when it came they had become Insolvent, and bad made assignments; consequently his judgments against them were worthless. It seemed certain now THAT MRDt-EI.L WOCLD FAIL, and the other infringer, not being made parties to the suit, continued ' to flood the market with machines. As the machines last about 10 years, it was hoped to fill the market with enough 'to supply the demand until the patent expired; but the gritty farmer began separate suits against all the manufacturers, and finally obtained injunctions against them. But this was costing money, and when the panic of 1373 came on he was in debt $130,000. The markets were supplied, and times bo hard that threshers could not bny machines unless they could get credit, and Mr. Bird ell was not in financial condition to give them credit Consequently, during the most of 1873, 1S74 and 175, HI8 SHOPS WEHK CLOSED, while infringers were still selling wherever they could work in a machine. His investments in shops and tools up to that time mounted to $182 000. and though he bad sold many machines, his profits had not hn snfflrient to pav bis debts. Badgered by numerous willful, powerful and determined infringers, this meritorious inventor has dragged his patent through yoars of litigation often delayed through lack of means, and at an almost incredible waste of human endurance; always confiding in bis patent as the pledge of the government, he bas risked all, apparently to lose everything. Auditor Thomas Hanlon, of Floyd county, is still improving, and the chances are favorable for bis ultimate recovery. Tbe libel suit of Xixon M. Jordan vs. Linn L Collins, publishers of tbe Wabash Courier, Is on trial in the Miami Circuit Court, on a chanee of venue. Jordan is a colored barber. and about a year ago the Courier charged that the barber's Itch had been contracted in bis - hop. Jordin claims tbe statement dam hg?d him $1,000, and be sued for that sum. In the contested election cases of C. L.' Jewett agi'.nst Judge Allison for judga of the Fifth ciicult, and V. Kirk aeainst J. F.
