This was au action f assupsit brought by Smith against Conklin lor money paiii, oat. and expended. Trial by the Court and judgment for the plaintin. There was evidence tending to prove that certain rent due to Smith, the piitintiff, from a tenant, who had occupied certain real estate of Smith's, had been improperly received from the tenant by Conklin. Blackford, J., held That if it be admitted that Smith ha a legal claim aoftinst Conklin for the money received by him, it cannot be recovered in this action for money paid. The proper form of action would be for money had and received. To sustain a count for money puid and expended, there must have been a payment of money by the plaintiff to a third party til the request of tha defendant, express or implied, on a promise, express or implied, to repay the amount Judgment reversed with costs. II. Morgan e. thi Lawrknceburgii Insurance CoxrNY. Krror to the Dearborn Circuit Court. This was an action of assumpsit brought by the Lawrenceburg Insurance Company against Morgan, upon five promissory notes alleged to be executed by him, and which appeared toliave len executed by Morgan and Swift. Pleas: 1st. That there was not. at the time, the unit was commenced, any such corporation in existence a the plaiutiffs; 2d. non-assumpsit. Demurrer to the first plea which was sustained, and general issue on the second. O.i the trial of the issue the notes were objected to on the ground of variance, and the objection tion overruled. Judgment for the plaint id Blackkord. J., held 1st. That the first plea is substantially good. If the , plaintiffs were not a corporation when they commenced the suit they must foil, if, by a persen's giving a note to : a party as a corporation, he is prevented from denying ' tiiar, when the note was given, mere was such a corpo ration, that is no reason that he should not allege that .1 did not exist when the uit commenced. 2d. That there is no variance between the notes in evidence ami those described in the declaration. The notes are joint and several and it was not necessary that the declaration should notice that Swift had executed them. They were the several notes of the defendant and could be declared on as if he alone had signed them. Judgment reversed with costs. HI. Smith e. Hazzard, er I. Error to the Tippecanoe Circuit Court. Indebitatus assumpsit, bv D. B. Smith and G. S. Hazzard against H. B. Smith. Two counts one lor goods sold and delivered, the other for money had and received. Verdict and judgment for the plaintiff. The defendant objected to the judgment lt. That the deposition of Chas. E. B.iily should have been sup pressed ; 21. That notwithstanding a change of venue was ordered, the cause was tried by the stme cou-t that made the order; 3d. That the evidence does not sustain the verdict. Blackford, J., held 1st. That it was immaterial whether the motion to suppress Bailey s deposition was correctly "overruled or not, as the deposition was not read on the trial. 2d. That, as the transcript shows that after the order for :i change of venue was made, the cause remained in the court in which ihe order wa made, and was continued from term to term for several terms; and as the parties finally appeared aud submitted their cause to the jury upon whose verdict, the judgment now in question was rendered, the defendants, therefore, waived the right of removing the cause under the order. 3d. That there ia not the -lightest reason to doubt the sufficiency of the evidence to sustain the verdict, as one witness gave in eviden e that he heard the deleudaiit acknowledge that he had purchased aud received the goods, and owed the plnintin's (he money, for which the suit was brcnght. Judgment allirmed with six per cent, damages and IV. West r. Chasr. Error to the Elkhart Circuit Court. Bill in chancery by Chase again t West, to compel the latter to convey to the former a certain lot in the town of Elkhart. The lot was sold to Chase, who was a potter by trade, by West, for '250 dollars in potter's ware. For the payment of this sum, Chase gave five notes, due at different times, of 50 dollars each. The first three were paid as they became due. and when the two latter became du. Chase set aside, in ashup in F.Ikhart county . potter's ware sufficient to discharge the not-. but there was no one to receive it. Decree for the complainant. The only difficulty in the case was to decide, from the depositions, whether the shop at which the ware was set aside, was the place where Chase carried on his business. Blackford, J., held That the depositions sufficiently proved that the shop mentioned was the complainant's place of bnsiuess, ami that therefore, when the ware wa.- set aside it became the property of the defendant Chase, consequently, must be considered as I wing done all that the law required in order to fulfil l is part of the contract. Decree affirmed. V. Spanglf.r and Spangler r. McDaniei.. Error to the Booue Circuit Court Assumpsit by C. and G. Spangler against W. McDaniei. McDaniei owed the Spanglers fifty seven doland fifty cents, in payment of which he gave them an order for the amount on one James A. Duulap. Dunlap died before the Spanglers presented the order, and they presented it to his executor, who refused to accept :t because McDaniei had withdrawn all his funds lro.ii the bands of Dunlap before his death. The defendant pleaded non-assumpsit, and non-assumpsit within six years. J udgment for defendant . Perkins, J., held That the order described in the declaration was prima facie, an acknowledgment that the sum named in it was due from McDaniei to the Spangler, and was the foun dation cl an action; and, being a written acknowieugment, in legal effect, of a debt due fiom the draw took the debt out of the statute of limitations. McDaniei having drawn hi funds from the hands of Dunlap before the order was presented for payment, was not discharged from liability because of the delay in presenting the order and the lack of notice of its non-acceptance and non-payment. Judgment reversed. VI LrjfH r. Thi Statb. Error to the Judgment of Hon. Alvin P. Hovey, in Vanderburgh County. John W. Latin, indicted lor murder, and confined in jail in Vanderbugh county , 'petitioned, in vacation, the president Judge of the fourth judicial circnit for a writ oi habeas corpus, to enable him to give bail. Tbe writ was ordered, and the Sheriff returned as the cause of Lunn's detention, the indictment of tbe grand jury of Vanderburgh county, charging him with murder in the first degree, and a proper mittimus directed to the jailor. Lunn's counsel then asked the judge to let him to bail. and offered to adduce proof that the grade of offence of which he was really guiliy was bailable, but the judge refused to permit such proof to be given and remanded the prisoner to custody. The prisoner appealed, and contends, that, thongh presented hv the grand jury, he had a right lo go behind tbe indictment and prove to the judge that the offence ol which he really is guilty is a bailable one; and that, upon making such proof, he was entitled to bail. Perkins, J., held That the decision ol the judge below was in accordance with the English authorities, and must be affirmed unless our statute has changed the English rule. The provisions of the habeas corpus act of this State, authorizes the judge hearing the application, to cause notice in writing to be given to tbe party interested in resisting it, or hi- attorney, to summon witnesses to testify in the premises, and to lully invettigate the case; therefore, the objection of the English judges that they cannot get at the evidence necessary to the correct understanding of the law. does not apply here. As under an mdietment for murder in the first degrc. tin- ci- n charged may be convicted of minor offences, such indictment should not be taken as conclusive of the grade of oflenee in determining the question of bail. Decisions below reversed and canse remanded for further proceedings. VII. Thi Madisois Imsubancf. Company r. GairriK. Appeal from the Jejjersan Circuit Court. Motion for Judgment upon an awari in favor of Griftin against the Madison Insurance Company, and judgment rendered. The Insurance Company execnted a policy to Griffin upon the cargo of a flat boat. Griffin claimed compensation for an alleged lose. The board of direotors of the Company proposed an arbitration, which was accepted by Griffin, and arbitrators were sctec .y Griffin and the Secretary o( the Company. Tbe ecetary executed the bond for the Company , and he and the attorney of the corporation attended at the hearing hy the arbitrators, and near its close, the Secretary, under tbe advice ol the President, revoked the submis! sioa. The arbitrators disregarded the revocation, and unanimously made an award in favor of Griffin. The award was filed in the circnit court, and a rule was granted by the court and served on the Company, to show cause why tbe award short Id not be made the judgment of the court. The Company answered, and gave eight reasons why the award should not lie made the judg. meot of tbe court. The 4tb, 5tb, 6th, and 7th objec tion raised tbe questions whether there was a legal submission, and whether there was a legal revocation- the eighth was that the award was uncertain,- the first was that notice of the meeting of the arbitrators not giv en, and the second and third were that the arbitiatort
re I used to continue the hearing, in order to give the defendant lime to bring in additional witnesses. PaaKiNS, J., held 1st. That the hoard of directors had made a valid agreement with Gritfin to submit the matter to arbitrators. Thi included the giving of ike bond required by the statute, which bond was executed by the Secretary, under the seal of the Company ; and there is no doubt thai the submission was valid if the Secretary was authorized to execute the jond. That bond was necessary to be executed by ar. agent, and the Secretary was properly that agent. A valid submission was therefore made. There was no valu. revocation of that submission. The agreement being made by the board of directors, and not by the Secretary or President, it was, therefore, not competent for them, by virtue of their own authority, in the absence of any by-law specially empowering them to do so, to revoke that submission. A submission should be revoked by an authority equal to that which makes it. 2d. That the award, being that "the company shall forthwith pay to said William Griffin the sum of 754 dollars and 74 ceaU. and the same shall be received by him in foil satisfaction and discharge of his claim against said company,' is not uncertain, 3d. That the first objection is 'immaterial, as both
parties were represented by their altorneys at the meetmg. 4th. That as the obiect of the continuance asked for by the .iefendants was simply to obtain the opinions of three witnesses, as to the per cent, of damages done to the a: tides named, and not to procure proof to show that the ompany was not liable at all on the policy ; and as the arbitrator offered to hear the case, with the exception of these witnesses, and adjourn fur a reasonable li rte. to be named by the attorney or agent of the company, in order that said absent witnesses might be brought before them ; and as the defendant refused the continuance on these terms, he cannot complain of the conduct of the arbitrators in proceeding after his refusal. Judgment affirmed, with one per cent, damages and coats. VIII. Spv.ars r. Clark. Appeal from the Tippeca iOe Circuit Court. Assumpsit bv the assignee against the assignor ot a promissory note. Plea, the general issue. Judgment for the plaintiff The defendant contended that in a suit bv the as. ! signee, ajraist the makers of a note, due diligence requires rat an execution shonld be issued on the judgment against them, as soon, at least, as the day following i the rendition, whether hat day fell in term time or vacation; aud that the insolvency of the makers at the time this suit was commenced, should have been proved Perkins, J., held 1st. That the rule in suits hy the assignees against the makers of notes is, that executions on judgment.-, may be delayed till a reasonable time for the issuing ot execution has elapsed, after the adjournment of the term of the court at which judgment is rendered, unless some specinl oause be shown to exist making it thedu'.y of the party, as an act of good faith, to issue it earlier 8J. That the plaintiff, in li.e Circuit Court, having shown that he had used due diligence by prosecuting the makers of the note to insolvency, was not bound to prove that they continued iusolvent to the tune of suing his assignor.
