Without such airimeiit, the ground of the Court! action may be nmuo-detstood,-and ihe defendant may not ba propcily appii-ed, befoieh-md, of tne case which be has tu meet. In these cases, we ate the more ready t lay hold of the omissions, as we feel a reluctance tu stop two hundred mills from giinding a bushel of grain or sawing a buaid, without giving the defendants a chance of making a settlement or cmprmie. On the other baud, it is by no means our intention to compel this complainant, to la-litigate hi p-tent already establi-bed at law, again t a combination of two hundred wealthy mill owners, in this distikt, who are, as these defendants allege, using machines, of which the m del above described, is the lepiesentatiou. By an amendment of this bill, the complainant may oveicome bis picsent technical difficulty. No ground has been shown for the imputation, that an attempt has been made by this complainant, "to levy black mail," as it is called. Indeed, his coure towards these defendant, as well as other prnons, appeais to have beeu one of gieat libeiality and forbearance; and I advi-e these defendants to settle with htm. II they do not, damages may be found against them, to the extent of their profits fio n the use of this patented improvement; at all events, amounting to the whole profits of their mill, since the nne of filing these bills. This might be no more than equitable. On default of e'tlemeut by defendants, the Cuuit will order the injunction to issue, no the first Monday of Apiil next; the complainant, to the meantime, so amending hi bill, as to allege the establishments here at law, of hi title to au exclusive tight in this improvement, and filing the affidavit uf tha surviving patentee, which ha been read to us in the course of the healing. Dr. Burden's attention was called away from it reading when it came to the House as a Senate amendment, and some of the other city and country members seemed to notice it. To rectify the mistake, a resolution was offered to call upon the Governor to return it; but tli is motion was negatived by a large majority, 45 to ST. The Governor will now have to oppose or tiga it, as he finds most proper. He vetoed the North Lebanon Railroad bill, pissed under like circumstances, and with a similarly smuggled section. Pa. Ldger. Ellen Bright, familiarly known in England as the Lion Qiieen, met with a shocking death on the occasion if one of her performances. She was in the habit of entering a cage with a lion and a tiger, and there g'ing through certain exploita with the animals. Ellen f.itered the cage with a small whip and struck the tiger, who 6ent forth an angry growl; she repratcd the blow, when the animal reared upon her, and mangled her neck and head with his fangs. A keeper standing by, rushed to her assistance, and succeeded in releasing her after beating the tiger over the he.id with an iron bar. The woman was taken out, and notwithstanding she was promptly attended to by a military surgeon, who was present, died iu a few minutes. SrxsixG a Shaft bt tiir Pkessurb or the Atmosphere. A novel and interesting method, known as the Pneumatic process, of forcing hollow cylinders into the earth by the pressure of the atmosphere, is about to be adopted in the navy yard, Brooklyn. Tr.e shaft for a well will be sunk on Monday morning next, near the commander's house. It is 32 feet in length, and it is expected that the pile w:ll descend in about five or six hours. The invention has excited great interest among the civil engineers, and a patent has recently been granted fur it. .V. J Jour, of Commerce. The Westminster Review, for January, contains an ankle on epidemics, wherein the writer hovs pretty clearly that the Asiatic cholera did not come from Aia, but was known in England and other parts of Europe hundreds of yeats ago. He als attempts to show that there is no such disraeo as hydrophobia, resulting from the bite of mod-dogs. In fact he flatly denies that there is such a thing as canine madnes. . There i not much consolation in this, if true, as long as persons die of a terrible disease ascribed heretofore to the bite of dogs. Alaeming to Undertakers. The detths in New York have diminished since 1317 at the rate of three thousand a yenr. A chrono-thermal prnctitioner ascribes it to the different treatment of diseases, and the abnndonmcnt of the use of the lancet. lie makes a calculation that the same ratio of diminution of deaths throughout the Utiited Slates, estimating at 22.000,000 of population, would show a saving of loO.OOO lives a year. The Hawk Eye says that Mrs. Ireland and her danghter, of Quincy, Illinois, came to an awful death by freezing and starvation on the mountains during the past winter. They were on their way to California. Gaskins, the young man who was arrested in Janunry list by a special agent of the Tpst-office Department, charged with the robbing of the Uni'ed States mail, took place on M unlay last before the Circuit Ourt of Ciiarleston, S.
