Thus far only could the creditor oppres and puuisli his dobtor in England, in that (which we sometimes call) dark and burtarous age; in that land of oppression, where wealth and capital legitimately rule; and the right üo to du is scarce ly questioned. Liut we, who live in the uinetceuthj century, in the Sta:o of Indiana, where we boast if our freedom, tqucdily and benevolence, have certainly improved upon this eyste-n of refined barbarity, and until recently, went the whole hocf. with our writ of execution; and sld goods, lands, body, aoul and all! I was first in favor of this law, merely because It would eave from penury, want, and oftentimes total destruction, wholu families, when the Father and Lueband, cither by misfortune, extravagance or accioVnt, become the victim debtor of a ebylock creditor. And indeed, this is a sufficient argument for the adoption i'f this law. . I What justire is there in our present system! The moot of the iinpoiu deUts are so. either because the debtor has been overreached and taken in by the creditor, if L may use that expression, or that the debtor of his own free will, unfortunately extended his debts too far, or else lias been unfortunate in losses, sickness or i-therwise: none of which acts are per ie, criminal; but unfortunate acta in which the creditor and debtor are eqnally to blame, if blame is to be attached at all to either. Then why permit one of the co-actors to punish the other, and tear from him the last vestige cf happiness, or the means to render his family comfortable and happyl There, is no justice, reason, or sense, in the vile system ; it is a disgrace to our statute book thus to put it in the power of one of the contracting parties to puuisU the other for a failure to perforin his part of the agreement. Yes, to permit him to inflict a punishment upon his victim, more severe than that which is inflicted on men guilty of the ordinary crimes in our State. For stealing a man's horse, you lock the Allow up in a prison a short time, with plenty of wholesome food, and comfortable clothes; for violating a civil contract von wrench, from htm the last foot of a that soil that his God intended as an inheritance for liini; you take from him and his family the last hope of procuring in this world, forever a comforta ble living. Then who is punished the severest, the tliief or the debtor! I need not answer. Why all this legislation in favor of the creditor against the f'ebtnr ! It looks as Mioogh we thought, if we would but take care of the creditor, the creditor would takcaref the debtor: we have seen the kind of care they have taken, snd what does it amount to? Such care ai the wolf lakrth of the lamb! Forages past, laws have been made with a view to enhance the interests of the rich cred.tor. Let us now for a while legislate for the poor debtor, and see in the passage of this la'w if it docs not manifestly tend to the improvement of the whole community. There will be much less difficulty in the collection of debt, than now. In the firl place, no one can then lonj obtain a crcd.t, w! o is not known lobe hoopst and willing to pay his debts; snd secondly, it will eliminate the poor man to honest industry, first to obtain a home, and then to become a good, honorable citizen; it will give him the means to rear and educate his family ; thereby benefiting the world, by making good citizens of them, which the poor creditor can nut now do; for as fast as a dollar may come into his possession, it may be sacrificed under the executioner's hammer. What encouragement has a man under these circumstances, to make any exertions to pay his debtsl none sir, none. It has been argued that this law would assist the dishonest man in defrauding those who would give him credit. Now it does seem to me that this is not a very efScient argument, for there is not an intelligent lawyer living but wlmt well knows, that where a nan his set out with the intention of defrauding Hie world and obtaining money by his credit, for the purpose of keeping it from his creditors, there uever yet was a law made that could collect from him a dime. A man ronynow, and could even when it wan yet legal to imprison for debt, have money in his pocket, and some do have thousands of dollars, and yet the law will not enable their creditors to collect one cent. AN ACT relative to appeals and changes of venue from Probate Court. Sic. I. Be it enacted by the General Assembly of th State of Indiana, That herenfer, nothing contained in the provisions of 33 1. 31ih and 35th sections of chapter 39, of the revised statutes of 1843, shall be so constructed at lo prerenl causes being taken by appeal or writ of error, from the circuit rourts of this Slate to tha supreme mort, which originated in tbe probate courts, by ei'Jier of the parties to the same; but such appeal may be taken, and writs of error sued out, as in other rases; and the supreme eourl ha'l have the same jurisdiction thereof, and entertain, bear, and determine (he same, as though such causes had been taken in tbe first instance frutn such probate courts, without regard to the derision of such causes in the circuit courts. Sec 2. The clerk of the circuit courts shall, io making out sny transcript of the proceedings in any such case, (which sha'l include the transcript from the probste court.) tax thereon all the feet accrued in tbe circuit court, and the same shall be included in the judgment of the supreme court sgainst the losing party, and shall be collected by fee bill or otherwise from ssid supreme court, snd by tbe clerk thereof paid over to the clerk of such circuit court for the use of the parties entitled thereto. Szc. 3. Tbe party taking up any auch cause from any circuit court, shall comply with the usual rules and regulations in other cases; and the supreme court shall certify their determination of any such cause to the proper probale court, and the after proceedings therein shall be in every respect the same as though such cause had never been taken to the circuit court Sec 4. That in all cases pending in sny probate coutt, either of the parties thereto shall be entitled to a change of venue to Ihe circuti court of the same county, where any öf the objections shall exist against the judge thereof, which now by law authorize a change of venue from the circuti courts in cir, case; and it shall be granted upon the same terms. Be it enacted by the General Assembly of the State 0 Indiana, 1 hat an act entitled an act exempting personal property from execution," approved Jauuary 13th, 1845, be so amended that f ir tbe purpose of ascertaining the value of the property by taid act reeerved, exempted and saved from execution, tLe execution plaintiff, his agent or attorney may select one spprsiser, and the defendant or defendants another, both of whom shall be resident householders of the township where turh levy it about to be made, who, after hsving'tsken aa oath or affirmation, to be administered by the officer holding the writ of execution, faithfully and impartially to discharge their dutii's, shall proceed to make a just snd true valuition of the property exempted by the act to which this is an amendment. Sec. 2. In case said appraisers shall not agree upon tha value of the property to be set apsrt and exempted from execution and ssle, they shall select a third person of like qualifications, in which case the appmisweut of any two of them shall be Isken as the true value of such properly, and said appraisment when so made, ahall be delivered to the officer holding the execution, to be by him returned to the court whence execution issued. 8c 3. In all cases when either of the parties shall re fute or neglect to select an appraiser, or in rasa any person selected shall refuse to serve at tuch, it thall be the du ly of the officer holding such execution to sppnint some person or persons posesed of tbe proper qualification! in the place of tuch person or persons to neglecting or re fusing. Co it enacted by the General Assembly ef the State of Indiana, That it thall hereafter be the duty of the Tresurer of State, lo famish to the Agent of State in the city of New York, in time for tha psytnent of the interest nn the public debt tn be psid by this Stale, auch sum or sums cf money as may be necesssty therefor. Sec. 2. For the payment of the annual salary of the Agent of Stale, the office expenses, expenses of travelling. and all personal charges of said Agent, including clerk hire and all other expenses to execute the duties of said Agent, except Ihe necessary charget for stationary ami postage, the sum of two thousand five hundred dollars it hereby ap propriated to be paid out of the Treasury of the State up on the proper requisition of said A sent. Stc. 3. Any certificata or certificates, either state or Wabash and Erie ranal. with ihe seal of the State upon it or them, signed by D. Maguire. Auditor, and Samuel Hannab, Treaturer of State, or their tuccessors in offire, and countersigned by the proper Agent of State, shall be aa obligatory upon this State as if the same had tbe signature of the Auditor and Treasurer of State in office at tha respec tibe dates of such certificate or certificates. Tbe Agent nf State is hereby required to report. in detail, quarterly, lo the Auditor of State, the precise amount, and number of certificates issued. outstanding, to whom issued; the amount is-ued outstanding tn esch person or persons; alto ihe amount of bonds and coupons surrendered snd cancelled, specifying the amount of eacb repaiatety, and it is hereby made the duty of the present incumbent at the cose of bis term of office lo make a similar report lo ihs Auditor of S'ate.
