The Legislature of 1-I'-H. granted to the State Hank the privilegfl of issuing small notes, under certain restru-tioiM. The graut uf this right is contained in two act. The first was approved Feb. 0, 1641, and the second, u hich is aw amendment of the first, was approved Feb. 15, Mil. The Cth section of the act of Feb. f, is as follows : M It ahal! lie lawful for the State Bank of Indiana t I MM and circulate notes of a denomination Jess t.ian five dollars, to an amount not exceeding one million of dollars." This provision in the same and a subsequent sec tion, is guarded by five province or conditions ; and the Ifonk had no nyht to is-ue sniall notes, under the Statute, only in compliance with the terms of each and all of the provisos.
