Sheriff Carter has appealed his case from the County lioard to the Circuit Court, involving the collection of $375 CO, for admitting aid releasing prisoners, which was reIc8?d by tho board last week. In the suit of Duncan McDsugall vs. the C. H. and I. Road for d&meges for stock killed, which came from the Hancock Circuit Court on a change of venue, the Circuit Court jury gave a verdict for $150 or plaintiff. Mary Bishop has sued for divorce from Frank Bishop, whom sha married in March, 3:42, immediately after which Frank abandoned her. He also has failed to provide for her. Frank is a rtddent of Clinton County, Iowa. In the suit of Samuel Adams vs. the city for personal injuries alleged to have been tuatained by plaintiff while working on a broken wall at tha Eist street crosaing of Pcgue'a run, tho jury in Room 'J yesterday found for the defendant. The mit of Richard Johnson vs. Luther Bellinger and others was tried by a jury yesterday in the Circuit Court, and a verdict for 520 was given for the plaintiff. Toe suit was brought on a Si3 cote, and tha dn'ense p!eaded that it was void bacause of Its ex ecnticn on Sunday. Martha Kay has filed suit against John Kay for divorce. They were married in Prut sis,-Germany, in November, 187'.. In April, 1SS3. John retnrnsd to Germany, and ainco then hai failed to provide for hi3 wife and one cbild. Mar Iba asks for the cstoiy of tho child, and for her maiden name of Kattlofski. William H. Wishard yesterday filed an affidavit in proceedings supplementary to execution against Corjdon R. McLaughlin, alleging the taking of a judgment for $ U, and If sue of an execution which was returned not satisfied. It is alleged that a number of parties are indebted to McLaughlin ia the aggregate sufficient to pay off tha judgment. Viola L. Husted has filed suit against Thomas S, 1 lusted for a divorce. Plaintiff is a resident of Warren Township, and Thomas lives in Clarksville, Tenn. They were married in September, 1SG7. In her complaint Viola alleges she is informed that Thomas and one Lizzie Winslov are now living as imftband and wife in Tennessee, be having Iflft her a je&x ago to-morrow and taken tha T7inelow woman with him. Viola asfcs for the custody of the four children. In the damage suit of Frank M. Wright vs. the city, Judge Howa yesterday -granted defendant a new trial. Several weeks ago the plaintiff recovered a verdict for $2.700 dameg?. Motion for new trial wasvthea overruled and both parties moved for judgment on the verdict. The questions were con sidered by the Superior Court Judges in general term, and upon the questions as tD the character of the weather on the night when plaintiff had his leg broken, the condition of the streets generally at the tlmo and several . minor points. The new trial was granted. The case against Venda Shultz for surety of tha peace came up before Judge Norton yeaterday. Mrs. Shultz was tried for malicious trespass last July, and acquitted. Soon after that the was filed against by the same person who caused her prosecution for treirats, this time before 'Squire Woodard. The case went to Southport on a change of venue, and came from there on appeal to tha Criminal Court. The evidence was similar in many respects to that cf the former trial, and related to the killing of a lot of cattle in Mrs. Shulfz neighborhood. The argument will be made Saturday. Rcawell .R. Rousa yesterday filed suit against the R. R. Rousa Manufacturing Company for the appointment of a Receiver, allf ging his ownexsaip cf 110 shares of the capital and the indebtedness of the defend. ant to him of $1.030.17, evidenced by'two notes, both of which are due and unpaid. It ia also alleged that the corporation is in imroipent canirer of becoming insolvent, and that it is owing to various partus amounts aggregating 10,CGO. Plaintiff asfca that until the farther order of the Court he may be permitted to continue the buslnfs. The Court appointed Julius A. Hanson Receiver, xtbo qualified by giving bond in tha sum of $10,0lf Henry Bennett Root and Deioss Root, executor of the will et Kate H. Rtot, deceased, and for himself, have filed suit egainat Joseph Montgomery, William Green, the First National Bank, Sheriff Carter and otherr, to quiet title and to restrain the Sheriff from making a levy and sale of certain property. The complaint is very lecgthy. and aets out that in 1S75 the decedent, Kate H. A new bridge is being built at Findlay and connection willjbe made with the I., B. and W., giving the lu.e an Indianapolis outlet. A number of new freight cars are being delivered to the T., C. and S. for joint use oyer its own and the I., 1. and W.'s lines. This road, it will bs re membred, was recently Bold under foreclosure. The new owners are of the opinion that it will develop into a paying property. The time is coming when the railroad that can not advertite "fast" trains in all directions will cut no figure in the race for business. Rapid time is being made on railroads throughout the East, and Western railroad managers are not permitting the grais to grow under their feet. There was a time when the people of this country would have Ecoßed at the idea o! a train running sixty miles an hour, and it has not b?en many years since, either. May 24 the Bee Line peoplo will change their time table, and some wonderful time will be made over this road between East and West Oar track and read-bed are in splendid condition." said a B?e Lice official yesterday, "and," he continued, "there is nö reason why wo shnnld not make as ecod time as any other road in the country." Flooring in all cases to be three ; inches in thickness and to be spiked with six 6J inch spikes twice in each intersection. Bridges to be constructed of the bast quality of good, sound oak timber.
