Afterward plaintiff married Nancy Wcodard. He then had his brother convey the lot to his wife, and with her he had an understanding to the effect that the property was to be regarded at all times as his abs'jlntely. Afterward, upon his order, his wife conveyed the lot to another person, and anew lot was purchased in ßpann'a'addition to this city. Upon both lots plaintiff had pnt valuable improvements and he had this second lot also put in his wife's ran.e, with the eame understanding as before. Again the lot was sold and a new lot was purchased and valuable improvements were placed the) e ;n. Meanwhile plaintiff's wif 3 died, and upon hearing that he was about to be suea on a bond, ho consulted with William Pattisou, an attorney, who advised him to have the lot conveyed to hia daughter, defendant herein, which was done on the same verbal understanding as that which he lad with his wife in their former transactions during her life ime. The complaint says that Sarah Catharine Pigg cow refuses to surrender the property to him upon request, claiming it as a bona lide transfer 0 the property by her father to her. Plaintiff also alleges that Wcodard, his step-son, claims an interest in the property as heir of Nancy Pigg. deceased; that he, plaihtlff, is tow sixty-five years of ae; that all his worldly possesions are in this piece of real estate, and he asks that th9 Court st aside the deed to Sarah Catharine Pigg and quiet his title as against her and Woodard.
