Senator Winter has introduced a bill to prevent discrimination by telegraph and telephone companies, and prescribing a penalty of "MOO when such discrimination is mad?. The Berkshire Life Insurance Company, cf Massachusetts, yesterday filed a volumincms complaint against the Indianapolis National Bank, Henry Tutewiler, Trustee, . George H. Carter, Sheriff, and otherj, for ininncticn. Tbe complaint- eis oat that in December, 1670, E. S. Aivord mortgaged lot one and part of lot two in square eightyseven to tha Thames Loan and Trust Company, to secure the payment of $10,000, and üf ierward he mortgaged the same premises to the lame company to secure 115,000 borrowed money. In April, 1 sSO. thesa niort . gsges were assigned to plaintiff for 23.101. li. la' 131 Aivord mortgaged this and other property to plaintiff to secure ?JS,073.5l, besides other aims paid fcy plaintiff on judgments against iim amounting to more than ?30.000. All -of tbse debta were merged into one and secured by mortgage, Aivord giving a note due jn ten years for 100,000. The mortgage 'ebt i3 wholly unpaid except ? 3 000, and tbe rents and profits are noc sufficient to Day tbe interest on the remaining $'.H,000. for 13.003.71, and decree of foreclosure, and afterward be took a judgment against Aivord personally for $1,210.31, and issued execution. Tutewiler assigned this list judgment to the bank, defendant herein, but it la alleged that this was a security for a pre-exist-irg debt, and that the bank paid Tutewiler nothing for the judgment. Afterward the bank ordered the Sheriff to sell the real estate above described, and in accordance therewith the Sheriff has posted notice of the sale on the 11th (to-day). Plaint iff claims the judgment for f 1,210.31 was erroneously taken, and that Aivord la not only insolvent, but a non-resident of the b'ateof Indiana. Among other thing3 it li alleged that part cf the property involved in these complications is that donated by Alvoid to the School Commissioners, on which tbe pment Public Library building is located. Prayer is made for an order restricting the defendants, the bank, Tutewiler and the Sheriff from disposing of the real estate conveyed by Aivord and wife to this plaintiff, and that the bank and Tatewiler be ordered to enter upon the proper records of the court satisfaction of the julgmeat and all other proper relief. The Hanlons1 wonderfully clever spectacular pantomime, "Fantasma," has made a hit here, and could run a week. It is the best thißg of the season and has "caught on" imrxenstly with everybody. One of tbe best things in it Is in the second act, where the Fairy 2aeen discloses a number cf beautiful tableaux representing the charms cf love, of the Bacchanalians, of wealth Md luxury. Beautiful girls appear under a bower of Howers and vainly try to entice in! heart of tbe lover, wfco is seeking lis io-t sweetheart. These charming pictures i j followed by others of an amusing nature. A little girl, five or six years, is altogether the most charming figure in these pictures; her face is a delighiful study for an artist, her poses are beautiful, and she is altogether ingenuous and interesting, Another incident cf the programme is the fwerd combat between Sijr. Fastorini and fcur antagonists. The man holds a sword in each band and performs a feat in s wordsmanihip that is wonderful for Ü3dexter.ty and the great physical power disp!ayed. The ioxxi men assault him at once, and he succeeds In parrying the blow3 of all of them. Mona. Lcuis f izzarello given an exhibition of violin playing, that is, in its way, as rere ark able as the sword combat He holds the bow in his mouth and plays "The Carnival of Venice," or holds ituader his legs and dances on one fcot In time to the music, or holds it with his knees, or over his head, or behind his back, and never misses a note. This gentleman is the clown of the piece, and he 13 an admirable facemaker as well as a good athlete. All of the numerous people composing the company are excellent. Mi33 Rata Davis, who plays "Fantasma," has a hne voice, and ehe is a bright actress. Her burlesque imitations in the last act am exceedingly clever, and her vocal gymnastics are unusually good. The scenery ol the play is fine and the music is pretty. Altogether "Fantasma" is the best performance of the kind ever seen here, and every man, woman and child in Indianapolis should see it. Among the musical selections Mr. Charles L'Orage's original medley, composed of thirty or more difierent airs, was peculiarly pleasant. Matirce to day at 2, and final performance tonight at 8. CHARLOTTE THOMPSON AT ENGLISH'S. Owing to a cold contracted by Mr. Craig early in the week, which had rendered his voice hoarse, the programme had to bs changed for the balance of the engagement, "cll Gwynne" was put on last night and played to a fair bouse. As "Nell Gwynne," Miss Thompson does some fine comedy acting. She dresses and acta tbe part in a meritorious manner. Mls3 Edna Courtney also acquits herself creditably; there is a br'ght future before this lady, if artistic talent and handsome face and form are a criterion to judge by. Mr. Craig is a clearheaded and a painstaking actor, but at the piesent time he is laboring under a disadvantage. "Jane Eyre" will be played at tbe matinee this alternoou, and "Eaat Lynne" this evening. Both plays are stand ard attractions, and the company is wei qualified to present them satisfactorily. KOTE3. John Gilbert, tbe "only Leon," Frank Cusbman and Johnnie Rice, have recently teen added to the "Cold Day" Company. Tbe transformation scenes at the end of each act cf "Fantasma" rival those of "Excelsior" and the "Naiad Queen" in magnficent eplecdor. Governor Gray was one o' the delighted spectators in tbe audience at the Grand night lefcre last He, like everybody else, eays 1 Fantasma" is the grandest spectacular piece ever produced here. Miss Kate Davis, the handsome and talented leading lady of the "Fantasma," cmpany, made a great hit last night with her Eoner, "Sweet Genivieve." She has a voice of wonderful range, and is also a clever comedienne. The sale of seats for tbe engagement of James Arthur's "Cold Day" Company at the Grand tbe first three nights of next week, opens this morning at the box-office. A special programme will be given on St. Fatrick's Day for tbe benefit of the Emmet Guilds. The comedians, Robson and Crane, will present the following repertorie hero cext week: Thursday evening, "Sharps and Flats;" Friday. "The Cherubs;" Saturday watinee, "Our Bachelors," and Saturday evening, "Our Boarding House.' The entire series of performances will be for the benefit of the Light Infansry. The Sentinel wants to fully and heartily indorse the following taken from a recent issue cf a Cincinnati paper: "Percy C. Maynall Is the name of a little Englishman who acts as manager for the Hanlons, and is thcroughly English in every way." But such an Englisnman, unlike the generality o! th? importations from the old country connected with the profession.
