The defendant, who pleaded not guilty, said that the lawyers were humbugs, and informed the' Court, that he would plead his own case. Mr. Kitchen spread himself, and made a speech. As we learn the 'incident' in the case, some two years'ago,-ur thereabouts, an individual residing in Kenton county, by the, name of Owed 11. Powell, in the pobsvfisiuii of a wife ami chiM, emi* l grated to Indiana, declared himsejf a citizen, nud brought suit in one of the courts of that Ijintc lor a divorce, one obtained it oven before' he bad obtained u citizenship. Having thus repudiated his wife, in accordance with the laws of Indiana, be came back to Kenton county, bis actual rest deuce, unit married another woman, wun has (-iuco added another youngster to his household.

The evidence in the cuse was beard, and when concluded, Judge Moore, .in delivering bis opinion, declared that the course pursued'by Mr. Powell, in going to Indiana was all a farce; Powell was a citizen .of Kentucky,, aud therelore no legal divorce could he granted by anyi court in Indiana; the plaiutili, Mrs. Dorcus Powell, 1 was then tbe legitimate wite of Owen It. Powell, and tbe Circuit Court over which he presided had no power to decree a divorce. • *
