Powell, in the pobsvfisiuii of a wife ami chiM, emi* l grated to Indiana, declared himsejf a citizen, nud brought suit in one of the courts of that Ijintc lor a divorce, one obtained it oven before' he bad obtained u citizenship. Having thus repudiated his wife, in accordance with the laws of Indiana, be came back to Kenton county, bis actual rest deuce, unit married another woman, wun has (-iuco added another youngster to his household.

Powell, and tbe Circuit Court over which he presided had no power to decree a divorce. • *
