ABOUTIOS 0P UW3 FOR 'mE COLUCTION.OP DEBTS. \Ve find the annexed article on the proposed abolition of the law lor enforcing tbo payment of debts; in tho financial department of the New York JnJeperJevt. j The subject is one that is beginning to attract a good deal of attention, and the more it is agitated the morc favorably wi]l it be regarded by the public. Credit fs uow too cheap, and in this respect measnres of reform, should be adopted, ; For this there is a growing ueccasity, and there is no plan mat will meet the case more fully, and speedily than that proposed. Abolish all laws for the collection of debts, and leave creditors to their own powers of discriminating character'when giving credit. This is the point to wbith our growing civ* iltztiun lends, and to wbuh practical wisdom and ‘philosophy point, A Vo have long since abolished lho.in : human laws which used to imprison dchtors, in which ‘abolition we took the lend of old Europe. Wo have how to lead.the way in a more imporUnt refdrm. A great proportion of the bad debts made, arises from tho malting of business on irapru dci)t buyers extending ercdilvaml in retying oh tho law for enforcing payment. When; without remedy at law, tho seller of. goods would look oxt’lasiycly on characlor—established character—wherever credit was given; and credits wonld ba more proportioned to the known means ol tho debtor, both as regards amount and time. The expenses attending ■ tho collecting of debts aira very grea t , and absorb a largo portion of. the profit. In cases of failures among tho dealers, their debtora as is well known, apt to advantage, and delay, if not altogether refose, payment of their debts. The law U ro : sorted to by them for evasion; . The , moral effect of this proposed abolition of the law to 'compel payment of debts, which it docs so imperfectly and at so great an expense of money or time, wonld be great. It would be felt by all traders,.-that to obtain any credit a reputation for character must be <ob ained, and constantly maintainihH It would also be felt by the seller that it would not answer to tempt buyers to buy too mneh. The seller would ho -more cautious. Besides, cash transactions would' increase and speculative dealings diminish. The. evasion of the present laws . for the collection of debts is very easy to the dishonest man, aided by professional advice; and numerous instances abounds of men having become rich by'running largely in debt/ putting their property so acquired out of reach and setting ell laws at defiance. Rich men abound whose property is ill settled on their wives, or held in trust for them by others, which in the absence of a bankrupt law, can not be reached. Indeed if do law existed to enforce payments of debts, men would look into the moral habits of their debtors before trusting, and not afterwards. They would not be so ready to seduce, by illicit means, any set of men to make purchases. Men so facile of character as to be so led are never reliable.
