Three aliens in Indiana face
..{deportation as members of the
Communist Party, it was revealed (today: by Thomas M. Pederson, director of the United States Im‘migration office in Hammond. A {fourth person is under suspicion (and a hearing is in progress. They are: Jacob A. Rusak, a native of Russia, who has been’ living. in Hammond. . ? Albert Joseph DesRoslers, also whose previous citizenship has not been clearly established.

James Elwood Mackey, now livIng in Gary but who came from Canada, Katherine Margaret Hyndman, also of Gary. Her previous citizenship has not been established. Rusak, DesRosfers and Mackey have admitted they were members of the Communist Party, officials said. Miss Hyndman is suspected of being a Communist but has not made such an admission to government authorities. The three men have had hearings. DesRosiers had been ordered deported Feb. 1. However, both still are living in Indiana, apparently seeking to appeal the deportation rulings.
No Decision in Case
Rusak's hearing is over but the decision has not been announced. Miss Hyndman’s hearing is in progress at the present time. Under the new McCarran Se curity Act and a ruling of the United States Supreme Court Monday they can be sentenced to as much as 10 years in prison for failing to leave the country. Previously, it was the government’s obligation to obtain tgavel papers for those ordered deported. But under the new act, sponsored by Sen. Pat McCarran (D, Nev.), the aliens must try to procure such travel documents within six months after the issuance of a deportation order or six months after enactment of the Infernal Security Act of Sept. 23, 1950. The McCarran act provides that either present or past membership in the Communist Party Is sufficient for deportation.
