Trial Set To Reconvene ‘Tomorrow

By DONNA MIKELS Illness of a juror caused a re cess today in the manslaughter trial of Lewie 8. Thomas in Criminal Court 2. Mrs. Kathryn Froney, 3350 N. Gladstone Ave. was unable to report for jury duty this morning. Judge Saul I. Rabb ordered the trial recessed until 9:30 a.m, tomorrow.

The state yesterday rested its

case in the prosecution of the 61-year-old former in the fatal stabbing of. fellow worker, Harry Eads, last fall. This was the incident officials of the Marion County Home for the Aged tried to “hush up,” and dismissed as “minor.” Thomas, who has freely the penknife stabbing, is expected to repeat the same story he told at his arrest when he takes the stand tomorrow He claimed he resorted to the knife after Mr. Fads “pieked” on him. He claimed his vietim hurled an ash tray at him and finally threw hot coffee in his face. Already a string of prosecution witnesses have testified on erossexamination the dead man had a reputation of *bullying” in his role as ward boss at the county infirmary. Yesterday Deputy Sheriff Willlam Owen introduced a state-

ment made by Thomas after Mr.

Eads’ death, two days after the stabbing. Other witnesses described the altercation which preceded the fatal stabbing and the discovery of Mr, Eads body in his room two days later. The defense lost a motion ask ing Judge Saul I. Rabb to direct the jury of six men and six wom en to return a not guilty verdict The motion, as the state rested

its case, contended the state has’

failed to prove the stab wound was responsible for Mr. Eads death,
