By». ANDREW TULLY ; Scripps-Howard Staff Writer . WASHINGTON, Dec. 4 — The Capital's latest” whodunit, “the case of the reluctant prosecutor,” was still running to a packed,
J gressman waiting in the wings to! 2% explain whether & he'd ever played WORN AA Svengali to an assistant -attorney general's Trilby. The big question now is whether discharged Assistant Attorney General Theron = Lamar Caudle k . = had heen “perJ susded” by Rep. Mr. Boykin i Frank W, Boykin (D. Ala.) that the Justice Department had no tase against four Alabamans involved in a $400,000 ‘tax fraud. Mixed in was a charge by a witness that the defendants con- & tributed substantially to the DemB® ocratic Party, Mr. Caudle could point to the fact that two of the defendants— Samuel Ripps and Joseph Mitchell —eventually were fined and sent to prison.
could ask whether this was because, or despite, Mr. Caudle’s efforts, particularly. after hearing one of Mr. Caudle’s former assistants charge that Mr. Caudle sought to block the prosecution and never tried to speed it up. Snubbed Thereafter
In fact, said John H. Mitchell ¢ (no relation to Joseph Mitchell) | Mr. Caudle was so annoyed at him after the indictments had been returned in the case that he (Mr. Mitchell) was snubbed by| Mr. Caudle and. refysed further
§ Mr. Boykin to refuse the defend- ® ants’ contribution to the Demo- # cratic party—supposedly between $50,000 and $75,000—but that Mr. Boykin insisted upon accepting it. It'was not established whether the contribution was made. Mr. Boykin’s role, according to ' both Mr. Caudle and John Mitch- ® ell, consisted largely of “dozens” " of telephone calls to Mr. Caudle, seeking information on the case and pleading with Mr. Caudle to “pe fair.” Mr. Caudle said he lost track of} * the number of times Mr. Boykin # called him but recalled that once * when the Congressman had him ' on the phone he (Mr. Caudle) " could hear “women wailing and *. crying in Mr. Boykin's office.” Mr. ¢ Caudle said Mr, Boykin identified . the women as Mrs. Ripps and . Mrs. Joseph Mitchell and told him, ‘these women are driving me crazy.” Evidence Leaked
John Mitchell had more sinister, hings to say about Mr. Boykin, known on Capitol Hill for his nonsinister slogan, “Everything is %. made for love.” He testified that A “in some way,” there had been a {leak and Mr, Boykin knew all the % details of the government's case . against Ripps and Joseph Mitchell ¢ and could explain everything in = the defendants’ behalf, “step by | step.” Moreover, said John Mitchell,
