Ayres & Co. Wins Suit On Gross Tax

A gross income tax decision with far-flung ‘effect on merchants in the state was won yesterday

by L. 8S. Ayres & Co, The decision handed down in Superior Court 3 refunded to the department store $7464 which had been paid by the store on merchandise sold out of the state, The suit had been filed in 1949, and was tried before William R. Higgins, former judge of Superior Court 3, who was continued as special judge in the case after his office expired last Dec. 31. The store also won a favorable tax decision on charges for alterations and other services,

Pay Lower Rate

The court ruled stores could continue paying the retail tax rate of one-half of one per cent, now five-eighths of one per cent with the bonus; instead of the full one per cent, now 1.25 per cent with the bonus, on service charges. The ‘Gross Income Tax Division had separated the receipts from merchandise and those from service charges, and had tried to collect the full rate from the latter.

and other retail merchants in like situations will pay the retail tax rate on the entire receipts from ‘the sale of such merchandise as women's. apparel, draperies, and floor coverings. L. S. Ayres was represented by Baker & Daniels.

Shoe Buyer Here 49 Years Dies

Maple Churchill, buyer at the Stout shoe store here 49 years, died this morning at his home, 2707 Boulevard Place. He was 73. Born in Nicholasville, Ky., he had been an Indianapolis resident 75 years. He was a member of the Bethel AME Church, and Knights of Pythias Lodge. He was secretary of the Central Masonic Lodge 20 years. Services will be at 1 p. m. Monyday (in the Stuart Mortuary. Burial will be in Crown Hill Friends may cal at the funeral home after 9 a. m. Sunday. Surviving are a brother, Luther, Detroit, and a niece, Mrs. Dorothella Rackard, New York.

Judge Bayt Lenient With ‘Future GI’

Judge Bayt today. .showed leniency to a 19-year-old motorist scheduled to be inducted into the armed forces in three weeks. The judge relaxed hid usual policy of giving jail sentences for all drunken driving convictions and fined Charles Estes. 931 N. Ewing St, a total of $41 and costs on three charges. Officers testified Estes was arrested after an 80-mile-an-hour chase. He was charged with drunken driving, public intoxication and reckless driving. After the defendant told of his impending induction, Judge Bayt omitted the usual jail sentence but did suspend Estes’ driver's license for 90 days.

$10,000 Gift To Elect Taft In '50 Bared

By United Press WASHINGTON, Nov. 30 E. Tate testified today that Robert A. Taft received a 10.000 contribution from the oil-rich Pew family in Philadelphia in his suc cessful re-election campaign. Mr. Tate. campaign treasurer for the Ohio Republican, said he did not solicit that contribution, but did solicit large out-of-state contributions for Sen. Taft on trips to Detroit and Chicago. He told a Senate Elections Subcommittee that contributions also came in from Texas, but denied he visited Texas last year. The Cincinnati business executive said he assumes the out-of-state contributions were reported, but he is not sure. . . Mr. Tate named only Webster Atwell as He did not remember how mich Mr. Atwell contributed, but he could recall no contributions from Texas of 35000 or more. Mr. Tate is now treasurer of the - Taft-for-President campaign. He testified before the subcommittee investigating the 1950 state election in which Sen. Taft was returned to the Senate by a big plurality over State Auditor Joseph T. Ferguson, his laborsupported Democratic opponent.
