Phone Rates Stand, Say Bell Lawyers
The Indiana Bell Telephone Co. has legal right to collect higher
. rates granted it last summer de-
spite a state Public Service Commission “maneuver” to strip the utility of the boost, its attorneys said today. > “The rates now being collected under an injunction are not affected by the most recent maneuver of PSC,” Attorneys Thomas D. Stevenson and Patrick J. Smith said. “Present ratex will continue in effect pending a decision in the case.” The Commission believed Marfon Circuit Judge Llovd D. Claycombe was duty-bound to wipe nut all court action taken in Bell's behalf, including a rate hike of at least $5.4 million. But company spokesmen said “we will oppose the motion when it comes before the judge.” Bell's current rate schedule was threatened in.a surprise move hy the PSC late Wednesday. The Commission rescinded its order: of May 31 limiting the utility to a £730,000 a year rate increase, It was that order Bell had appealed to Judge Claycombe taining an injunction against PSC and ‘a temporary rate boost Iligurged by the companys at $0.4 million’ and by the Commission at $7.2 million. The Commission 30 hearing to consider ‘new materially different evidence” the utility offered in court in a bid for a permanent rate increase of $10,162,000 a vear.
