LOS ANGELES, Nov. 8— A Supreme ' Court test of baseball's reserve clause ap-

peared probable today as a

result of the latest action by a player challenging the right of the sport to keep him inactive. { Attorneys for Pitcher Earl Toolson announced they would appeal the ruling of a Los Angeles federal court judge who dismissed the player's $375,000 antitrust suit against organized baseball. u = ” DISTRICT Judge Ben Harrison pointed the way toward a final Supreme Court ruling in Toolson’s case by saying it was up to the Supreme Court to decide if a 1917 ruling that declared baseball to a sport and not interstate commerce was still valid. Toolson had sued the two major leagues, the New York Yankees, the National Association of Professional Baseball, the Pacific Coast League and two coast league clubs. He charged he was kept from playing baseball by being placed on the ineligible list by the Yankees. The 29-vear-old pitcher's troubles began when the Yankees shipped him to the San Francisco Seals on option. He failed to catch on there and played briefly with. “We lost the battle but we're going to win the war,” said Toolson's lawyer, Howard C. Parke of Santa Barbara, Cal., pointing out that Judge Harrison's ruling made the case subject to appeal. He said he would carry the case to the 9th Circuit Court of Appeals at San Francisco.

Toolson in his suit here claimed that a- 1917 ruling by the late Justice Oliver Wendell Holmes was no longer effective because radio and television broadcasts made baseball cross state lines and put the game into interstate commerce. Holmes had ruled that baseball was a sport and the mere fact that a team traveled across state lines did not make the game interstae but a local contest played at the field of one or the other
