Acting contrary to the 1951 State Legislature were the five members of the General Commission, policy body of the Indiana School’ Board, and State Supt. of Public Instruction Wilbur Young. They were aware their action failed to follow this new statute. “The General Commission of the State Board of Education, on the basis of available data on enrollments and assessed valuations, shall make estimates, and whenever available appropriations will be insufficient or in excess to make a full distetbutiop as herein provided, shall on or before July 1 of each year, adjust the local foundation tax rates for tuition and transportation purposes upward or downward in like amount for the ensuing year.” The educators made an esti-

They said their attempts at an estimate were fouled by the absence at that time of any court ruling about whether the 1949 teacher pay schedule or the higher 1951 schedule will be used; by lack of adjusted assessment figures; and by their own failure to decide how much to distribute in transportation funds, They knew ihe Commission missed before on estimates. And it would have been embarrassing
