Accused Repeatedly In Weight Cases

WASHINGTON, Apr. 6 — An-' other official of the Defense Transport Administration (DTA) is associated with a trucking grm which has a record of repeated violations of state truckweight laws, « Henry E. English, director of DTA’s street and highway division, is president and owner of the Red Ball Motor Freight Lines of Dallas. - Texas highway recoxds alow, 329 violations of state weight laws py the company since late 1948. In the past seven months, more Red Ball trucks have been caught! violating the gross weight law, than ‘in the previous year. The! company also operates in Louisiana. Texas authorities said they had| 40,000 miles of highway to check | against overloaded trucks and, only 33 inspectors. : Appointed Recently
Mr. English was+«appointed to the DTA a few weeks ago—about the time the DTA began its drive to “liberalize” state truck- -weight| laws and persuade state govern-| ments to adopt’ a more tolerant attitude toward overloaded] trucks. This also is the objective of the American Trucking Associe.-| tions, Inc., (ATA), of which Mr.| English was president last year. The ATA is the national lobby of the big truckers, who account for only 3 per cent of the commercial vehicles but generate practically all of the pressure for lifting the limits on truck weights and sizes. © Mr. English works in the same part of the Defense Transport Administration as John L. Fraley, assistant (on leave) to the president of a North Carolina trucking firm which has 665 vigla-| tions on record of Virginia's weight laws. Mr. English is Mr. Fraley's superior. > Mr. English said he did not have the facts at hand to confirm or ‘deny the figures from Texas. He said he didn’t recall the amount of fines his company paid last year, or_ whether state fines were deducted from profits as a cost of doing business when! his company’s federal income tax statement was prepared. Privilege Ended
This was a privilege extended {o truckers by the Internal Revenue Bureau in 1942 and with‘drawn last Dec. 1. In effect it enabled truckers to pay part of the eost of getting caught with excessive loads out of funds they otherwise would have paid in federal taxes. Mr. English said that as president of the ATA he made many speeches urging compliance with state weight laws. “I always have told my own people to load within the limits,” he said. “If they overJoaded, it was against my wishes.” He pointed out that it was easy for a truck to be technically overloaded. He said it was not customary in either the trucking or the railroad business to Question a shipper’'s declaration of weight. ‘To weigh each load, he added, would take too much time. John Laine, 22, of 2619 Highland Pl, was arraigned before Juvenile Court Referee Mercer Mance today on a charge of contributing to the delinquency of a minor. He is accused of having harbored a 16-year-old escapee from the Juvenile Home. The girl is the one who figured in another juvenile court case which ended Tuesday. In this case John Donovan Young, 34, of 1318 N, Gladstone Ave, was accused of having contributed to delinquency when he employed her as a prostitute at the North Side Health Clinic, 2351 N. Meridian St. Young was fined $500 And costs and given a 30-day jail term on that charge. i
