Speedway’ driver, had arrived from Los Angeles.

Loral Tansy, local service station owner and race driver, has filed the replevin in Marion County Superior Court 1 in an effort to claim the motor which he contends he bought from Thorne last summer. The legal confusion was an unfamiliar twist to Speedway activity as other mechanics were readying 25 cars for tomorrow's and Sdturday’s qualification runs. There were rumors that an extra qualification date probably would be set aside before the running of the 500-Mile Race next Monday. Gates Open at 9 a. m. Inc, for $15,000, having made a $500 deposit. The engine is a six-cylinder Thorne motor, similar to the 1941 winner. Thorne sought to post a $20,000 bond today in order that he] might get the car in condition to qualify and race. Meanwhile, Sheriff James Cunningham has posted a deputy at the garage entrance. Given 24 Hours Cunningham said late yesterday that Thorne could assemble the car and not tear it down and that no parts could be removed] from the garage. Thorne was given 24 hours to post $20,000 after Tansy had posted a similar amount. Thorne contends that although there is a bill of sale between Tansy and himself for the motor, he never received any money from Tansy. Tansy said he was willing to let the court decide the fate of the chassis and engine and that if he gets possession, he will attempt to qualify the car before next Monday. Eddie Metzler, former mechanic for the Indianapolis Race Cars, Inc.,.and Paul Weirick are to be Thorne's mechanics. Meanwhile, the IRC garage showed indications of quick preparation after last week's squabbles over mechanics, Pete DePaolo, the IRC’S new manager, reports that both Maseratis are ready ta qualify. Clocked at 128 mph Lee Wallard drove the No. 15 Maserati yesterday and was clocked at 128 miles per hour. He said he could squeeze a few more mph out of the engine, the sa one that Ted Horn drove ‘las year. Chet Miller is supposed to drive this entry, but he may wind up as a relief driver for the Novi team. Freddie Agabashian and

THE HIPPODROME touch to tomorrow's qualification trials will be the 4 p. m. appearance of Gay, the horse that drives an automobile. Gay, by use of special gadgets, can start the engine, shift gears and steer the special 1941 coupe. The auto's top has been removed to make ,a stall for the horse.
