Constitutional Right, Prosecutor Says
* Release” of defendants on bonds pending trial is a specific provision | of both the U. S. and Indiaifa Con-| ‘stitutions, Prosecutor Stark’ said today in comnienting | upon implied criticisms of court bail procedures. Ji He pointed out that the cow and law enforcement officers were merely following the Constitution when they permitted an-ex-convict's release on $2500 bail in a burglary case last January. Investigation yesterda® disclosed that James Ralph Derrett, 27, of 608 Beecher St., has been free under $2500 bond on a burglary charge 11 - months “despite a record of 24 ar-| rests and six convictions in 10 years. Cut From $10,000 to $2500 His bond originally had been set at $10,000 but was reduced to $2500 in a habeas corpus hearing with the approval of two deputy prosecutors. “The Constitution expressly pro-| vides that defendants accused of | crimes except those of murder and ~lreason. be admitted to reasonable bail,” Prosecutor Stark said. | “Reasonable bail means a bond! somewhere within the ability of a, defendant to provide. The only pur- | pose to a bond is to assure the de-| fendant's appearance in court for! trial. The defendant in this case didn't attempt to leave the state and thus the constitutional purpose! of the bond procedure was fulfilled’ completely.” : The delay of 11 months in bringing the ex-convict to trial was the result of a congestion of jury cases in criminal courts, Mr. Stark explained.

$50,000 Mere Drip
In Damage Suit |
Injuries received as an aftermath, of a dripping faucet formed the basis for a $50,000 damage suit against the Martinsville Sanitarium in Federal Court today. Miss Ruth Kaiser of Cleveland, O,, said that the “bloop, bleep,” of a dripping faucet at midnight, Aug. 24, 1946, kept her awake while she was a patient in the sanitarium. She tried to shut off the faucet, but the porcelain handle broke. The hand injuries she received forced
her to drop her life's work, Sid
fitting, she claimed.
