The suit charged that the trustees of the estate had failed to carry out terms of Mrs. Hodges’ will in which she provided that her grandfather's diaries be published in book form for public distribution.

. Prosecution Requests Delay Until Monday

Times State Service GREENCASTLE, Oct. 3.—The embezzlement trial of Floyd J. Hemmer, former State Penal Farm superintendent, today was recessed until Monday morning. Special Judge Robert Stewart granted the delay on request of the prosecution. A former Greencastle assistant bank cashier, William Stiles, testifled - yesterday that he cashed a $075 check for Hemmer which had been made out by the State Farm to R. P. Olinger,. Huntingburg contractor. Mr. Stiles is now employed by a Marion bank. Mr. Stiles said that the check carried Mr. Olinger's name as endorser and also Hemmer's. Charged in Indictment Mr. Olinger later testified that the signature was not his. The canceled check, introduced Wednesday as an exhibit, showed also the name of H. P. Kunkler as second endorser. Mr, Stiles testified that the second signature looked as though it had been changed. Mr. Kunkler testified he did not endorse the check and had never seen it before the investigation started. He was employed by Mr. Olinger. Hemmer was charged with embezzlement in 13 indictments but is being tried on only one indictment.

Local Youth Dies 0f Car Injuries

John McCotter, 16, of 1814 N. Rural St., died yesterday in General Hospital of injuries received in an automobile accident in U. 8. 40

near Cumberland July 15. The youth was a lifelong resident of Indianapolis and was a student for one year at Cathedral High School. He expected to enter Technical High School this fall. Survivors are his father, John Joseph McCotter; two brothers, ‘William and James McCotter; four sisters, Mrs. William Butler, -Mrs. Jack Montell, Helen McCotter, and Rosemary McCotter, and a grandmother, Mrs. Katherine Maney, all of Indianapolis.
